Scaffolding
My neighbour's landlord needs to install scaffolding within my garden, For reasons I won't go into I have refused. If they go to court to force us to agree would their renewing soffits, fascias and guttering be classed as essential work, it certainly doesn't look essential to me.

They are all parts of protecting the building from water ingress so yes they can be essential

If the boot was on the other foot and you needed to replace your soffit and that involved putting scaffolding in your neighbours garden what would response be?

It doesn't matter if the work is "essential" or not, the Act only requires that it is "reasonably necessary".
You would probably have a tough and expensive job arguing that the work itself isn't "reasonably necessary".

What is it that you are worried about ? You could give permission provided the neighbour was present during installation & removal and made sure there was no damage to plants or garden. Make sure they agree to replace anything damaged at their expense.

Wht won't you go into the reasons? It sounds like you have a personal grievance with the neighbour and you are trying to make their life difficult. I know this story too well. All that will happen is that you'll make things even more tense and difficult with the neighbour which is never a good way to go. Just take the advice above, ensure you're there for the scaffold going up and down, and get something in writing to say they'll make good any damage
