Private insurance for flats

In the UK, is there a way of ensuring my flat is covered if other flat owners in the block brake the building insurance terms?

The risk at present is that one flat owners could invalidate the insurance for everyone in the block

    Assuming you are talking outside of Scotland then in most cases the freeholder will buy a block insurance policy which is a form of commercial buildings insurance. Whilst it's more expensive than what a standard Home policy would be it does tend to have many less restrictions and therefore the chances of one owner or occupier breaching the insurance is much lower.

    In principle you could buy your own insurance for your flat, in older properties in Scotland this is the norm however claims processes are often slow and painful as a consequence because in an incident involving multiple units you have to have all the insurers coordinating their efforts. In this scenario there are policies you can buy to protect against a neighbour being uninsured but there are terms attached which wouldnt apply in the normal setup in England & Wales where the lease makes the freeholder responsible. Probably worth noting that in Scotland there has been a move to appointing factoring companies or owner associations that buy a block policy on behalf of all the owners.

    Generally a block policy would be breached by the action of the freeholder or their agent. This would probably result in a breach of their contract to you and therefore make them liable for the losses.
