C1 Form completion advice

I am looking for help with completing the C1 form.  My father passed away and we need a certificate of confirmation for a bank account and also for some shares. I have been dealing with the estate and will be applying for the confirmation.

With paragraph 2 I was looking for an example of how best to word it. My Mum is listed as an executor, along with my two sisters and myself.(I am listed last). All the names, addresses are all up to date.

I would also like some advice (or an example) on how to enter the shares on the inventory.

My Mum received a lump sum payment from one pension provider and is receiving monthly payments from another. I wanted to check about these as noticed on the notes it stated that you should ignore any pension that continues to be paid directly to the deceased’s surviving spouse or or civil partner from the pension provider. Do I not list the one that the monthly payments are now continuing to my Mum and list the other pension that paid in the lump sum or do I list none of them?

Assuming a life insurance payment will be listed that Mum was listed as the beneficiary and payment was made directly to my Mum.

My Mum will still be staying in the house they shared, I am unsure about how best to calculate the cost of household goods, assuming 50% since my Mum still lives there.

 Any advice would be appreciated!

Assuming here that there is a will.
Are there actually four co-executors appointed? !  One option is for one or more to decline or resign.

But if all four are acting para 2 might look like:

    That I am

along with [mother’s full name] of [mother’s address], [sister 1 full name] of [sister 1 address] and [sister 2 full name] of [sister 2 address], the executor nominate of the deceased conform to his will dated the [      of         ] which is exhibited, docquetted and signed by me as relative hereto, and that I am the [son/daughter] of the deceased and that the said [full name of mother] is the wife of the deceased, and that the said [full name sister1] and the said [full name sister 2] are both daughters of the deceased.

Shares are listed where the company is registered. A description is entered in column 2, the share price is entered in column 3 and the total value entered in column 4. HMRC form C3 gives guidance.

A continuing monthly pension payable to your mother is not listed.

Most lump sum death benefits from a pension scheme will be outwith the estate where the pension scheme administrators have discretion on who will receive the cash.

Generally a life policy effected by the deceased on their own life for the benefit of the spouse is not part of the estate.

If you do not require confirmation for the house I presume that it is either not owned or it has a survivorship clause in the title.

Household goods generally have a low (or no) market (resale) value so unless there is anything particularly valuable it is normal to include a very modest value.

Thanks so much for your advice.

Checking the will it is listed as my Mum being the sole executor, then states whom failing, then lists the three daughters. Would it need to be my Mum's name on the C1 application or can I still apply?

I understand that the house in joint names on the title deeds although I need to check about the survivorship clause. The house won't be sold as my Mum will remain in the house, so this may also need to be included if it is in both names.

I appreciate you help, sure I will have more questions!

One option. Confirmation is applied for by mother as sole executor.

Otherwise, if the will contains no specification as to what is to constitute ‘failure’, then mother could decline the appointment with the effect that the three daughters would then be co executors. In this case the declinature would require to be written and signed and submitted to the court along with the C1 and also be referred to in the para 2 declaration. (In this scenario any of the daughters could also subsequently decline).

    Thank you.

My mum can apply as sole executor. Do we still list the daughters in para2 if my mum is applying as the sole executor?

    No.

    Para 2 would simply say

    That I am

the wife and executor [or executrix]-nominate of the deceased conform to his will dated [ of ] which is exhibited, docquetted and signed by me as relative hereto.

No reference to substitute executors, and no reference either to substitute executors in box 10 of page 1.

    Great, thank you.

Assuming I leave section 3 on page 2 blank?

The executor's full name is entered in the first box in para 3. The words 'along with the said' can be striked through.

The inventory is a list of assets as at the date of death - so an income tax overpayment would be listed in the inventory.

This payment came in January and my Father passed away in November so would this not be listed as was not an asset at date of death?
