25-26 Winter fuel payment after passing
The deceased's bank account received the WFP after they had passed.
The deceased passed after the September 2025 qualifying milestone, I've called the DWP and they've verbally advised that they won't be requesting the WFP is returned to them by the estate.
The deceased had net income higher than the £35,000 pa rate. Does this mean the whole WFP £300 amount is returnable or will it just be taxable?

With income in excess of £35K they were not entitled to the WFP so the whole amount is returnable. How (and if) that mechanism will actually work is anyone's guess in this situation.

Is their final year’s income still over £35k even though it is going to be well short of a full year?

The total income for the tax year 25-26 will be less than £35K
