Furniture order part delivered then discontinued

Hi All

I bought my daughter a bedroom furniture set just before Christmas - 1 bed, 2 x bedside cabinets, 1 x chest of draws and a single wardrobe. Oak finish.

Had to chase delivery and was told the wardrobe out of stock - to be fair I was offered at that point to either cancel the order or have the wardrobe removed from the order. We asked if the wardrobe would be back in stock and when and was told in writing that the wardrobe would definitely be back in stock towards the end of January. Based on that information we proceeded with delivery of the rest in December.

I'm now chasing the wardrobe and have been told the following:

`Unfortunately, the item is now out of stock and will not be getting restocked. I sincerely apologise for the earlier advice that it would be available again — I understand how frustrating this must be and take full responsibility for the misinformation.'

The retailer now wants to issue a refund for the wardrobe.

With a new set of furniture having it all match is obviously desirable - We are asking the retailer to collect all the items delivered in December and issue a full refund.

Based on the admitted misinformation does anyone know if I have retail laws on my side?

Thanks

Yes, assuming you ordered a single set of furniture the consumer rights act is your friend. For an incomplete order, the seller is responsible for resolving the issue within 30 days of purchase or by a mutually agreed date. You can demand delivery of the missing items, accept partial delivery with a partial refund, or cancel the entire order for a full refund.

If you ordered each piece of furniture separately it may be slightly more complicated...
