[PCN Cancelled] PCM - High Point Village/Hayes and Harlington Train Station PCN

Sharing this to help others. My PCN was eventually cancelled, but only after escalation.

1. Initial appeal to parking company (as keeper)

  • Appealed as registered keeper only (did NOT name driver).

  • Focused on legal / procedural points, not mitigation.

  • Raised:

    • Non-PoFA compliance (no clear parking period, defective wording etc)

    • Signage issues (availability ≠ legibility) and signage at height - unable to read whilst driving and under wet conditions

    • Breach was trivial - no obstruction or loss.

    • PCN did not clearly offer an appeal – front of notice framed it as pay or name driver, appeal info buried in small print on back.

Appeal rejected (expected).


2. Contacted landowner / managing agent (Ballymore HQ)

  • Contacted Ballymore via HQ email (Google/ChatGPT helps find correct addresses).

  • Case was picked up by a senior property manager.

  • Initially dismissed and sided with parking company.

During this exchange, Ballymore provided additional photos that were not included in the parking company’s evidence portal when the PCN was issued.

I used this to challenge process transparency / selective evidence disclosure. I tthen proceeded to posting a letter to Ballymore HQ as well.


3. Started IAS appeal (despite low success rate)

  • Proceeded to IAS to create a formal paper trail.

  • Focused on:

    • Signage legibility vs availability (can’t read dense terms while driving).

    • No opportunity to stop/read terms (stopping prohibited).

    • No grace period to leave.

    • Unfair contract formation.

    • Procedural defects.

IAS appeal was ongoing when next step happened.


4. Contacted my MP (parallel escalation)

  • Explained:

    • Keeper, not driver.

    • Predatory enforcement concerns.

    • No obstruction to traffic or other vehicles.

    • Operative present but no warning.

    • Pattern of enforcement at this site (including residents).

Ballymore + parking company told MP they still believed a breach occurred.


5. Outcome

Head of Operations reached out to MP case handler and I - stated they still considered there was a technical breach, BUT after discussion, PCN cancelled as a “gesture of goodwill.”
