Indeed. There was no way a prosecution would have succeeded in the circumstances described (providing it was properly defended).

I think people in your position are sometimes left up in the air as to whether they still need to reply to the s172.
Pity the police couldn't have explained everything clearly in the letter they sent you rather than you having to call them for clarification.
