    But, maybe the CS rep misdescribed the replacement, or maybe the OP misunderstood. Either way, he seems disappointed with a perfectly reasonable response to his problem machine.
    I think the OP was expecting new for old, i e. betterment.  

    Alas that's not what happened.

    No deceit here, you assumed it would be brand new but you had a used faulty item and got a used working item, which is correct. They don't need to state it, if anything a brand new item would be an unexpected bonus.

    The OP had an 18-month old used Kindle with a fault.  
    With the fault, the OP would have had an 18-month old used Kindle.
    The refurbished item provided put the OP into the position of having a used Kindle.
    Seems fair to me.

    You mentioned the box, but not the condition of the Kindle. If it's as good as or better than a typical 18 month old Kindle, then you're "whole" and I would accept it. Withdraw from the field of battle, and amend the title of this post. 

    If it's noticeably worse than typical, or damaged, then I'd continue with your battle
