CRA when seller says "no", to refund.

Purchased a new motorhome which I collected on the 9th of October 2025.
On the drive home, about an hour and a half in, an engine warning light came on.  Then a DPF regeneration cycle activated and completed, it did not clear the warning light.

The following day I contacted Fiat Assist and the sent a representive to try and resolve the issue.  No luck, was sent to nearest Fiat garage, could not look at the motorhome until after the weekend.

Returned to the garage on Monday 13th October, waited 8 hour to be told that a new DPF would need to be ordered.  Was infomed that 2 dpf recharges were attemped and the numbers had gone up rather then down, the garage representative said the this was strange.

Was then informed that the part, which was expensive and none returnable could not be ordered until the warranty could be confirmed snd tha I would need to produce the V5, which hab not yet arrived from the DVLA.

Having kept the company who sold me the motorhome informed of the issue from the outset, I finally requsted it be returned and a full refund made.

Fast forward to the 13th January 2026, I am still not in receipt of my money, stuck babysitting a motorhome that is not going anywhere an paying out, at the moment, over £3000 solictor cost, as the seller refused a refund.

The two reasons given for the refusal were: 1. The issue did not exsist at the time I collected the motorhome.
2. It was not a major fault.

The Motorhome cost me £85000.  The fees to get this into court will be 5% of the purchase price, plus ongoing legal fees.

I beleive the CRA is clear and my case is solid, but if the seller says no, then the recourse to law is expensive and time consuming.

After a divorce and selling of the family home I purchased the motorhome to live in full-time.  I am now stuck only using it to sleep in and have not used any of the facilties like toilet, cooking facilities, or shower.

I believe I have done everything right, but hear I am, stuck with no end in sight watching my bank balance dwindle which could ultimately push me into poverty at aged 64.

    Without wishing to sound rude, is there an actual question or is this just a vent?
    I ask because you state you have spent £3000 on a solicitor and they will be beter informed and hopefully more knowledgeable then a bunch of randomers on a forum.

    How did you pay for it? Finance agreement? Is it an unregulated agreement not covered by CCA?

    The price (£85k) would rule out the CCA, unless S75A applies.

    Even s75A only applies to items below £60,260....

    • Section 75a: Applies to purchases costing over £30,000 and up to £60,260.   

    • So no S75A either

    Why can you not use facilities, as DPF will have no effect on them.

    Isn't your solicitor familiar with CRA 19(14)?
    For the purposes of subsections (3)(b) and (c) and (4), goods which do not conform to the contract at any time within the period of six months beginning with the day on which the goods were delivered to the consumer must be taken not to have conformed to it on that day.
