THE BIRTHDAY DRAW: TERMS AND CONDITIONS

 

These terms and conditions were last updated on: 12/01/2026

 

For single entries, the terms accepted at the time of entry will govern, and for Subscriber Draws (defined below), the version dated at the start of the Subscription Payment Term (defined below) will apply. 

 

1. Key Definitions

   The following definitions have the following meanings in these The Birthday Draw terms and conditions: 

   Term	Definition
   The Birthday Draw	The overall promotion, which includes the Weekly Birthday Draw, the Daily Subscriber Draw and the Monthly Subscriber Draw.
   Daily Subscriber Draw	A daily prize draw available exclusively to Subscribers, as described in clause 5 below.
   Continuous Payment Authority (CPA)	Permission from an entrant for the Promoter to take recurring, regular payments.
   Entry	A single valid submission into the Weekly Birthday Draw, made either online or by post, which includes the required Entry Selections. Entries shall be interpreted as more than one Entry.
   Entry Period	The period in which the Weekly Birthday Draw is open for Entries.
   High-Value Prize	A cash prize of five hundred pounds sterling (£500) or more.
   Monthly Subscriber Draw	A monthly prize draw available exclusively to Subscribers, as described in clause 5 below.
   Monthly Subscriber Draw Date	The date of the next Monthly Subscriber Draw due to take place, as stated on the Website.
   Net Entry Sales	The total revenue made from Entries into the Weekly Birthday Draw, minus VAT and any processing costs.
   Official Documentation	An official government-issued photo identification document which proves an entrant's identity. (e.g. passport or driving licence.)
   Postal Entry Validation Period	The time following the Closing Time which allows for the receipt of Postal Entries, as set out on the Website.
   Promoter	ITV Consumer Limited, ITV White City, 201 Wood Lane, London W12 7RU and Global Media Group Services Limited, 30 Leicester Square, London, WC2H 7LA are the joint Promoters, responsible for all aspects of The Birthday Draw.
   Subscriber	An entrant who is either an Online Subscriber or a Postal Subscriber.
   Subscriber Draws	Collective term for the Daily Subscriber Draw and the Monthly Subscriber Draw.
   Subscription Payment Term	The 4 or 5 Weekly Birthday Draws that open in a given calendar month and which are covered by the payment made for that calendar month.
   Valid Entry	An Entry which, at the time of the relevant Birthday Draw, has been made in accordance with these Terms and Conditions.
   Website	www.thebirthdaydraw.com
   Weekly Birthday Draw	The weekly prize draw as described in clause 4 below.

2. Types of Birthday Draw
   1. The Birthday Draws consist of three (3) prize draws: the main Weekly Birthday Draw, the Daily Subscriber Draw and the Monthly Subscriber Draw. 
   2. The Weekly Birthday Draw runs weekly in accordance with the opening and closing dates and times set out in clause 4 below. 
   3. Daily Subscriber Draws and Monthly Subscriber Draws (together the " Subscriber Draws ") are only open to Subscribers. Subscribers are automatically entered into these draws for as long as they remain a Subscriber, as further set out in clause 5 below. 
3. Who can enter
   1. The Birthday Draw is open to entrants who are: 
      1. resident in the UK during the Entry Period;
      2. aged 18 years or over;
      3. not employees of the Promoters; and
      4. not in any way professionally connected to the companies within the ITV group of companies, Global Media Group Services Limited, Tectonic Interactive Limited, Nunki Limited, or are an immediate family member of the same (including any live-in partner); and connected with The Birthday Draw. 
   2. Entrants must have a UK mobile phone number, address and bank account in order to be eligible to win The Birthday Draw. 
   3. The Promoter cannot guarantee that entries submitted by eligible residents of the United Kingdom from outside the UK will be entered into The Birthday Draw. The Promoter gives no warranty that the service will be available for use in locations outside the UK. 
4. Weekly Birthday Draw

   Opening/closing dates & times:

   1. Entrants may enter the Weekly Birthday Draw either online or by post.
   2. The Weekly Birthday Draw opens for entries via the Website at 00:00:00 on Monday 12th January 2026 and then at 00:00:00 each Monday from 26th January 2026 (" Opening Time "). 
   3. The Weekly Birthday Draw closes for entries: (i) online at 23:59:59 each Sunday from 25th January 2026 (" Closing Time ") and (ii) via post following the Postal Entry Validation Period. 
   4. The Promoter can (at its discretion, acting reasonably) suspend or withdraw the Weekly Birthday Draw. If the Promoters decide to suspend a draw, entrants will be notified by email. 

      How to enter & cost of entry:

   5. To enter the Weekly Birthday Draw, an entrant will need to create an account via the Website. In order to create an account, entrants will need to provide their name, date of birth (" Stated DOB "), verified email address and verified phone number (" Account "). Only one Account may be created per entrant. Please note that if an entrant wins a prize, we may ask for proof of your date of birth. Once entered at registration, the Stated DOB cannot be changed unless the entrant contacts our customer service team and provides adequate proof of their date of birth. 
   6. Following Account set-up, entrants will be given the option to make an Entry into the Weekly Birthday Draw online or by post. 
   7. To make an Entry, entrants will need to provide the following information: 
      1. a valid six (6) digit date in DD MM YY format. This can be any valid calendar date within the last one hundred (100) years from the current date.; 
      2. the first letter of the entrant's name or any other letter; and
      3. one (1) of twelve (12) entry colours,
      (" Entry Selections "). 
   8. If an entrant has opted to make an online Entry, after making their Entry Selections they will be directed to the payment page to make payment and submit their Entry. 
   9. A single Entry to the Weekly Birthday Draw costs one pound sterling (£1.00) and payment can be made via PayPal, Apple Pay, Google Pay or debit card (as available on the Website) by following the instructions on the Website. Please note that use of a debit card (on all payment routes) may incur charges from an entrant's provider. Payment via credit card is not permitted. All payments are subject to the relevant payment provider's terms and conditions. 
   10. Where an entrant makes an online Entry, the Promoter must have received evidence of payment for the Entry (as notified to the Promoter by the applicable payment provider) by the time that the Promoter conducts the draw and that such payment has not been withdrawn. The Promoter is not responsible for the failure of any third party to provide evidence of payment. 
   11. Where an entrant makes a postal Entry, after making their Entry Selections they will be given a unique 16-digit postal entry code (" Code "). When using the postal Entry method no money will go to the Promoter. 
   12. Postal entrants must either print or hand write their Code onto a postcard or on the outside of a sealed envelope. Entries received on anything other than a postcard or a sealed envelope will not be accepted. Only one (1) Code may be submitted per postcard or sealed envelope. In the case of multiple Codes received on a single postcard or sealed envelope, all entries will be invalid and no entries will be entered into The Birthday Draw. We advise all entrants to print their Code using the electronic 'pdf' file provided. Any handwritten Codes that are not legible to staff working for the Promoter will be rejected at the Promoter's reasonable discretion. Entrants will not be notified if their Code is rejected. 
   13. Postal entrants must then post their Entry by affixing a stamp and sending it to The Birthday Draw, PO Box 8784, Derby, DE1 9AP. Entries sent by post must be received at the relevant postal address specified for Entries by the end of the Postal Entry Validation Period for the relevant Weekly Birthday Draw to which the Entry was submitted. 
   14. Entries sent by post without correct and sufficient postage paid will not be valid. Hand or couriered deliveries will not be accepted. 
   15. Any Entries sent by post will be validated within 24 hours of the end of the day of receipt. Once postal Entries are validated, the user's account will be updated to show the Entry(ies) as valid. 
   16. The Promoter is not liable for any delays in the receipt of postal Entries that are outside of the Promoter's control, including for any postal Entries that are lost or not received by the end of the Postal Entry Validation Period. 
   17. A postal Entry has the same chances of winning as an online Entry. 

       Entry capping:

   18. Multiple Entries are permitted but the number of Entries is capped at sixty (60) Entries per user account, per Entry Period (this includes all online Entries and postal Entries) (" Cap "). For the avoidance of doubt, any postal Entries generated on the Website but not subsequently validated, will count towards the Cap. 
   19. An entrant may make as many Entries as they like up to the Cap but they may not submit the same combination of Entry Selections more than once. 
5. Subscription Options

   Online subscribers

   1. Online entrants will be given the option to set up a subscription. If you choose to set up a subscription, the Promoter will request a Continuous Payment Authority (CPA) for monthly payment for at least one (1) Entry to the Weekly Birthday Draw. Entrants who have agreed to a recurring payment will become an " Online Subscriber ". 
   2. Subscriptions run for whole calendar months (" Subscription Payment Term ") and will be billed based on the number of: (i) online Entries subscribed to by the entrant; and (ii) Weekly Birthday Draws which will be drawn within the relevant calendar month (i.e 4 draws in a month or 5 draws in a month, as relevant), as illustrated in the following example:

   1. On the date an entrant becomes an Online Subscriber, the monthly subscription cost for any remaining draws in that calendar month will be charged via the entrant's CPA. All subsequent monthly subscription costs will be charged via the entrant's CPA on the first day of each calendar month. For example if an entrant becomes an Online Subscriber on 14 March, one (1) payment will be taken on 14 March to cover the period 14 March to 31 March and another payment will be taken on 1 April to cover the month of April. 
   2. An entrant may cancel their CPA at any point during the Subscription Term. Cancellation must be made before the end of the business day before the date you will be charged for the next subscription period to ensure you are not charged for the subsequent month. Once cancellation has taken effect no further payments will be taken by the Promoter. You can also contact your card provider to cancel the CPA – if you do this, please let us know. 
   3. Subject to clause 5.6 below, refunds will not be offered for cancelled subscriptions and any Entries purchased will still be entered into the applicable Weekly Birthday Draw(s) until the end of the then current Subscription Term. 
   4. You have a legal right to cancel your CPA (and therefore your Online Subscription) within fourteen (14) days of authorising it. You acknowledge that by making an Entry into The Birthday Draw, you are consenting to us starting the service immediately and any rights you may have to withdraw from or cancel your purchase (including but not limited to under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 ) will be lost because the performance of our services is simultaneous or begins immediately once your purchase is completed. Notwithstanding the foregoing, where an entrant cancels a CPA within the first fourteen (14) days, they may contact the Customer Services team ( help@thebirthdaydraw.com ) to claim back a pro-rata refund for any Weekly Birthday Draws that the entrant has paid for but have not yet commenced at the time of the cancellation. 
   5. Subject to the Cap, for twelve (12) Entries or more, Online Subscribers will be offered discounted Entries into the Weekly Birthday Draw per draw. Additional discounts are available after every twelve (12) entries e.g 24 entries into the draw is better value than 23 entries. The discounts available are as follows:

1. *Points of Entry discount

   1. Online Subscribers may pause their subscription for one (1) month, three (3) months or twelve (12) months by following the instructions on the Website. 
   2. If an entrant's online subscription Entry includes a leap year date that becomes invalid due to being more than one hundred (100) years old, the Promoter will automatically amend that entrant's subscription to the next valid date of the same year. The Promoter will notify the entrant of this change through their Account. 

   Postal subscribers

   1. Where an entrant makes at least one (1) Valid Entry via post to the Weekly Birthday Draw for four (4) consecutive draws, they will become a " Postal Subscriber " on the date following the fourth consecutive Weekly Birthday Draw. 

   Daily Subscriber Draw

   1. Subscribers that have made at least one (1) valid Entry into each of the four (4) Weekly Birthday Draws prior to the user's Stated DOB (DDMM only) will be automatically entered into the Daily Subscriber Draw taking place on the date of their Stated DOB (DDMM). 
   2. Entrants will only have one (1) Entry into this draw regardless of the number of Entries made into the Weekly Birthday Draw. 
   3. The first Daily Subscriber Draw will take place on Friday 6th March 2026 and each day thereafter. If a Daily Subscriber Draw is postponed for any reason, the Draw will be run on a subsequent day. 
   4. Where the Daily Subscriber Draw takes place in a year which is not a leap year and therefore there is no 29th February, the Promoter will perform an additional draw on 1st March to include all subscribers with a Stated DOB of 29th February. 

   Monthly Subscriber Draw

   1. Subscribers that have made at least one (1) valid Entry into each of the four (4) Weekly Birthday Draws prior to the relevant Monthly Subscriber Draw Date, will be automatically entered into that Monthly Subscriber Draw. 
   2. The number of Entries into the Monthly Subscriber Draw is equal to the total number of Entries made into the Weekly Birthday Draws that commenced in the previous calendar month. 
   3. The first Monthly Subscriber Draw will take place on Friday 6th March 2026 and each Monthly Subscriber Draw Date thereafter as set out in clause 6.4 below. 

   Subscription examples

   1. By way of example, if an entrant: (i) opts to become an Online Subscriber; or (ii) becomes a Postal Subscriber on Monday 25 May, the first time that entrant is eligible to be included in the Monthly Subscriber Draw is the July Draw that happens on 10th July (having been entered into the Weekly Birthday Draws commencing on 1, 8, 15, 22 and 29 June 2026). The first time that entrant is eligible to be included in the Daily Subscriber Draw is 26 June. In the case of a Postal Subscriber, if the Promoter does not continue to receive consecutive weekly Entries that entrant will cease to be eligible for the Subscriber Draws until such time as they enter four (4) consecutive draws again. 
2. Draw & contact
   1. The Weekly Birthday Draw will take place on the next working day following the Postal Entry Validation Period. 
   2. Subject to eligibility and compliance with all applicable terms and conditions relating to the prizes (set out in clause 7 below), those who have the following selection matches will win a prize as further described in the prize section below: 
      1. Date (DD/MM), Year (YY), Initial, Colour – Jackpot prize
      2. Date (DD/MM), Year (YY), Colour – Tier 5 prize
      3. Date (DD/MM), Initial, Colour – Tier 4 prize
      4. Date (DD/MM) and Colour – Tier 3 prize
      5. Date (DD/MM) – Tier 2 prize
      6. Colour - Tier 1 prize
   3. The Daily Subscriber Draw will take place by 12:00:00 each day. Subject to eligibility and compliance with all applicable terms and conditions, the first Entry drawn at random from all eligible Entries will win the Daily Subscriber Draw Prize. Daily Subscriber Draw Prize Winners will be contacted via email within fourteen (14) days of the draw taking place whereupon they may be asked to provide Official Documentation to verify their Stated DOB. In the event that the Stated DOB does not match the date of birth on an entrant's Official Documentation, their Entry will be disqualified, they will not win the Daily Subscriber Draw Prize and a new winner will be selected. 
   4. The Monthly Subscriber Draw will take place each calendar month on the first working day following the first Weekly Birthday Draw of the month, for Entries received in the previous calendar month. Subject to eligibility and compliance with all applicable terms and conditions, the first Entry drawn at random from all eligible Entries will win the prize as detailed on the website for that month. Winners must begin the claim process by following the instructions on the website and/or winner notification email. The Customer Services team will then contact the winner to arrange prize fulfilment. 
   5. It is the Promoter's intention to award certain High Value Prizes in a celebration ceremony which may be filmed for promotional purposes (at the Promoter's reasonable discretion). Please note that any public announcement of the winner's first name and postcode area made regarding the winner is at the Promoter's reasonable discretion and always in accordance with our Privacy Policy and any applicable laws. 
   6. All High Value Prizes, entrants will receive a notification of their potential win, together with instructions on how to claim their prize. Potential winners will be asked to initiate the claim from their account and then they will be called by the Promoter's customer services team to complete the necessary verification processes. 
   7. If a winner cannot be contacted after the Promoter has made reasonable efforts to do so within a reasonable period, or if the winner is found to be ineligible or unable to comply with these terms and conditions, the Promoter reserves the right to withdraw the prize from that winner. 
   8. Any entrant and/or winner must comply with any reasonable directions given to them by the Promoter, prize provider(s) and/or their agents and with all relevant laws, rules and regulations and restrictions. Failure to comply with instructions, rules, restrictions, requirements, laws and guidelines may result in an invalid Entry and/or forfeiture of the prize. 
   9. All prizes are awarded in accordance with the laws of chance.
3. Prizes
   1. There is one (1) guaranteed jackpot prize fund of a minimum of one million pounds sterling (£1,000,000) for each Weekly Birthday Draw. This jackpot fund will be shared equally between the entries that match all drawn Entry Selections (DD/MM/YY, initial, Colour) for that Weekly Birthday Draw. 
   2. The Total Weekly Prize Fund allocation for The Birthday Draw will always constitute forty percent (40%) of the Net Entry Sales (including an allocation to be determined at the Promoter's reasonable discretion for Subscriber Draw prizes). 
   3. For illustrative purposes only, if the Net Entry Sales of paid Entries to a draw totalled five hundred thousand pounds (£500,000), the total weekly prize fund allocation would be two hundred thousand pounds (£200,000) and this may be broken down as follows:

   1. For the avoidance of doubt, a winning Entry will only win the highest prize available for the selection matches it has matched, and each winning Entry is only eligible to win a prize from one (1) of the Tiers outlined above. 
   2. Any unallocated winnings from tiers where there are no winners (aside from the jackpot) will be rolled into the jackpot tally for future draws. 
   3. For the Daily Subscriber Draw, there will be one (1) prize of £100 available each day. 
   4. For the Monthly Subscriber Draw, the prize(s) available each month, will be detailed in advance on the Website. 
   5. In the event of any fault, mistake, misunderstanding or dispute concerning the operation of any part of the prize draw service, networks or systems, the decision of the Promoter shall be final subject to clause 10. 
   6. Winners are required to comply with all instructions and requirements as may be specified by the Promoter or any authorised third party to receive and/or take up the prize, including but not limited to providing responses within specified timeframes, completing any required forms and delivering any required documentation. The Promoter will not be liable to the winner or any other persons where they fail to comply with such instructions and such failure may result in forfeiture of the prize. 
   7. Any prizes are non-transferable and non-exchangeable.
   8. If for any reason the winner chooses not to take up the prize or any part of the prize, the Promoter reserves the right to ask the winner to confirm this in writing and, whether or not such confirmation is received, the Promoter will be able to retain or dispose of the prize (or part of the prize) at its own reasonable discretion. 
   9. The Promoter may void Entries, refuse to provide a prize, or seek the recovery of a prize, in the event of non-eligibility, non-entitlement under these terms and conditions or an entrant's breach of the interaction terms and conditions, fraud or dishonesty, including but not limited to the use of technology which enables an entrant to evade applicable charges when entering The Birthday Draw.

1. Claiming Winnings
   1. Where winnings are four hundred and ninety-nine pounds and ninety-nine pence sterling (£499.99) or less, this will be paid directly into the recipient's 'My Winnings' section of the Account. 
   2. Any winnings can either be kept in the Account and used as credit towards any future Entries into the Weekly Birthday Draw or can be withdrawn from the Account in full via PayPal. You must have at least one pound sterling (£1.00) in your Account to withdraw winnings via PayPal. 
   3. Prize winners must use any prize credit on single-entry purchases for the Weekly Birthday Draw and/or claim any withdrawable winnings to a PayPal account in their own name within twelve (12) months of the date on which the prize is awarded. Prize credit may not be used towards the purchase of any subscription. Winners will be provided with clear information on how to use prize credit or claim any withdrawal winnings and will be sent reasonable reminder notifications before the end of the 12-month period. If a winner does not use the prize credit within this 12-month period or fails to claim any withdrawal winnings, the relevant credit or withdrawal winnings will expire and will no longer be available. 
   4. Entrants wanting to withdraw over five hundred pounds (£500) from their Account will need to initiate a claim from within their Account first, which will then result in a call from the Promoter's customer services team to complete the necessary verification processes. 
   5. High Value Prizes will only be paid by BACS in the name of the entrant within 28 days of initial contact. Winners of High Value Prizes may be required to verify their identity and age by providing Official Documentation. Failure to provide such Official Documentation or failure to pass the verification checks will result in forfeiture of any High Value Prize. 
   6. Winners of very High Value Prizes are advised to notify their bank in advance of the BACS transfer being made. 
2. Manipulation of services
   1. The Promoter is committed to operating The Birthday Draw fairly, transparently and to preventing abuse of its systems, as well as those of its agents and sub-contractors. 
   2. You are prohibited from committing any of the following; and the Promoter reserves the right to disqualify and/or discount Entries /and or block the entrant's Account from making subsequent Entries if we have reasonable grounds to suspect, at our sole discretion, based on reasonable evidence, having regard to all the circumstances and information available at the relevant time, any of the following: 
      1. Entries have been made in breach of these terms and conditions; or
      2. there has been any activity which the Promoter considers is designed to manipulate or unfairly influence The Birthday Draw and/or provide an unfair advantage to an entrant including without limitation use of automated or semi-automated technology; or the making or disguising of multiple Entries by an individual entrant using multiple different email addresses (or other details on which limits on number of Entries are based). 
   3. If entering The Birthday Draw online via the Website: 
      1. the Website Account must be owned, maintained, used and controlled by one (1) individual. Entrants must not create or operate multiple user accounts or attempt to enter more than the number of Entries set out in the Cap, including but not limited to, creating multiple accounts using different email addresses, phone numbers or different, multiple, or variations of names; 
      2. entrants must not (and must not allow any other person to) use the Website for any purpose which is commercial, unlawful or otherwise improper. In particular, except as expressly permitted by these general terms and conditions, an entrant will not by any means as a result of or in connection with their use of the Website: 
      3. share their login with anyone else;
      4. remove, alter, bypass, avoid, interfere with or circumvent any software on the Website; 
      5. modify or obscure their IP address in order to enter The Birthday Draw if they are not eligible; 
      6. capture or store any personal information relating to other users of the Website; and 
      7. do anything that may cause damage to the Website or our servers, systems or equipment or those of third parties, nor access or attempt to access any users' data or to penetrate or attempt to penetrate any applicable security measures. 
   4. If we determine that an individual has attempted to unfairly influence or manipulate the service or has breached these general terms and conditions, then in addition to disqualification and/or discounting Entries, the Promoter shall suspend or terminate their accounts, disqualify and/or discount their Entries and withhold or reclaim the awarding of any Prizes. In addition, we may (in our reasonable discretion) ban that individual from using the service in the future and disqualify and/or discount any future Entries made in respect of our services. 
   5. We also reserve the right to take the action outlined in the paragraph above if we reasonably suspect that any entrant's conduct is contrary to the spirit of these general terms and conditions. 
3. Liability
   1. Nothing in these terms and conditions restricts your statutory rights as a consumer. For more details on these statutory rights you should contact your local Trading Standards Office or Citizens Advice Bureau. 
   2. Nothing in these terms and conditions shall exclude or limit the Promoter's liability for death or personal injury caused by their staff or suppliers' negligence or for fraud or for any other liability which cannot be limited or excluded by law or regulation. 
   3. The Promoter cannot promise that the services relating to The Birthday Draw will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily and without notice in the case of any problem with any network or line, system, server, software, or for any technical malfunction or failure, maintenance or repair or for reasons reasonably beyond the control of the Promoter. Subject to 10.1 and 10.2, the Promoter reserves the right to discontinue, modify or change The Birthday Draw in any way, in such circumstances and where such changes are material any Subscribers will be notified. 
   4. Subject to the first two paragraphs of this liability section, the Promoter: 
      1. does not accept responsibility for any fault, malfunction, damage, loss or disappointment suffered by you as an entrant or participant howsoever arising from participating in The Birthday Draw or from accepting any prize whether due to any error, omission by the Promoter or their employees, agents or others or by any other cause; 
      2. is not responsible for any damage or loss caused to you (i) which is not reasonably foreseeable to you and to the Promoter when you enter The Birthday Draw or (ii) is reasonably foreseeable to you and to the Promoter on entry but is only indirectly related to you entering or participating in The Birthday Draw; 
      3. will not be liable to reimburse the cost or expenses incurred in making an Entry into The Birthday Draw; 
      4. does not accept responsibility in the event that any Entry is lost, delayed or not properly received, registered or recorded or for any incorrectly addressed or undelivered The Birthday Draw Entries or for any disruption, delay or misdirection of such Entries; 
      5. reserves the right to amend any element of The Birthday Draw for reasons beyond its reasonable control, including but not limited to the unavailability of the prize draw entry platform before the closing date, or for strike, lock-out, labour dispute, illness, act of God, natural disaster, adverse weather conditions, war, riot, civil commotion, accident, epidemic or pandemic, malicious damage, fire, flood and/or storm, compliance with law or governmental order, rule, regulation or direction, breakdown of plant, machinery or transportation. The Promoter is not responsible for any loss or damage caused to you as a result of any of these occurrences. 
   5. You agree to reimburse the Promoter in respect of any damages suffered by the Promoter, or any losses by the Promoter resulting from any claim made by a third party in each case in respect of any matter arising from your use of the services relating to The Birthday Draw in breach of these terms and conditions or from your violation of any applicable law or regulation. 
   6. It is your responsibility to ensure that you control access to any email address that you use to enter. Subject to the first two paragraphs of this liability section, the Promoter shall not be responsible for any loss you suffer as a result of the Promoter dealing in good faith with anyone other than you who has access to any such email address (or any device using any such number). 
4. Privacy
   1. Information and data ("personal data") which is provided by you when you enter The Birthday Draw, will be held by the Promoter and may be used by the Promoter and their service providers, network operators, suppliers and contractors for the purposes of administering and fulfilling The Birthday Draw. You agree that this includes without limitation that we may contact you if there is an issue with the service. Further details of how any personal data will be used are set out below and in The Birthday Draw's privacy policy https://thebirthdaydraw.com/privacy and you agree to this use of your personal data when you participate in The Birthday Draw. 
   2. The Promoter and/or the prize provider may send personal data of participants (and where applicable, companion(s) of a winner) to third parties outside the European Economic Area, for the purposes of fulfilling the prize and by entering, you agree to such transfer for these purposes. 
   3. By taking part in The Birthday Draw you acknowledge that it is the Promoter's intention to feature you in publicity if you are a High Value Prize winner. You acknowledge that the Promoter (or any third party nominated by the Promoter) may in its reasonable discretion use the winner's (and if applicable their companion's) name, postcode area and image and their comments relating to the prize and their experience for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid. If you do not want your name, image and/or comments relating to the prize used for future promotional, marketing and publicity purposes, please contact help@thebirthdaydraw.com. 
   4. If you are a High Value Prize winner of the Weekly Birthday Draw, you agree that the Promoter may list your first name, last name and county on the winners' page of the Website(s) and may publish or announce your name and location elsewhere as the Promoter determines in its reasonable discretion. If you do not want your full name and/or location to be published by the Promoter or would like reduced information published by the Promoter, please contact help@thebirthdaydraw.com.

   1. You agree that you do not have any commercial relationship with the Promoter, and that you are not an agent of the Promoter.

   3. These terms and conditions are available in English only and shall be governed by and construed in accordance with the laws of England. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales unless you choose the jurisdiction of your domicile in Scotland or Northern Ireland.
