No refund from HMV due to "slight variation" technicality - is this right?

They might have had an argument if really was a "slight" colour variation. e.g. turquoise instead of cyan. But if it's a completely different colour (red instead of green), then that is an obvious case of "not as described". Opening the product doesn't remove your consumer rights - records aren't sealed for hygiene reaons.musicenthusiast said:
These are limited edition, yes. All copies have been affected by the manufacturers fault, and so sadly they won't be rare/collectors items, as there are no plans to press more (that I'm aware of). Ideally, I'd like a refund because they aren't as described/pictured, and I wouldn't have purchased them if I'd known what they actually look like.ButterCheese said:Is this a limited edition or something? Did they say they could provide you with the correct colour pack? And if so when? I only say because things like this (i.e. incorrect issues) might be collectors items in a few years time, once they re-issue the pack en-masse in the correct colours. Apart from that, what do you want from them? Your consumer rights as far as I know allow you to return the item for a full refund, you should quote the relevant section in your email to them. But you'll obviously have to return the record and its packaging, and then wait for the correct coloured issue to be distributed, if that happens at all?
As as aside, if *all* the records were printed in the wrong colour, why return them? (as you're not going to be able to get the "right" colour. Surely what's *on* the record is more important than the colour?0 -
Vinyl will be exempt from right to cancel if unsealed by the customer after delivery.
OP push back and state their disclaimer doesn’t cover a completely different colour and if they aren’t willing to arrange the return you’ll return it anyway and then perform a chargeback with your card provider.
Negative review on Trust Pilot might prompt a response as well.

I have paid a premium to a "limited edition" coloured vinyl and picture discs in the past. Generally wouldnt really care what colour they were unless there was a particular tie up like The White Album on white vinyl, Paint it Black on acid yellow vinyl etc. Most however was simply if I liked the look of the thing and wouldnt care two hoots what the colour combinations are.born_again said:Off topic, but I buy music because I like the song, not for the colour of the media it is on 🤷♀️1 -
Won't they actually become more collectible with the colour error?0

Presumably not, given thatouttatune said:Won't they actually become more collectible with the colour error?musicenthusiast said:

If they were looking miter edition items with the original colour why would they not still be different colour?
Presumably. they have produced the same number and no more to be manufactured
