DS1 and DS2 for charge removal 1999

Hi
i have helped my parents in law to review their details at the land registry.
It still shows that Birmingham Midshires has a legal,charge from 1979 followed by an entry from Bank of Scotland in 2007. I believe they now own BM.

They repaid their mortgage in 1999 and have a letter from BM to confirm this. 
When BM sent the title deeds to them they enclosed a DS1 and DS2 with instructions for them to complete the DS2 and send it together with the DS1 and charge certificate to the land registry so the charge could be removed. The land registry would then send them the land certificate.

Unfortunately they never sent these documents to the land registry which is why the charge remains.

If we complete these instructions now, will the land registry remove the charge or has the process changed since 1999?

    Process is broadly the same although we don’t need the charge certificate. Charge/Land Certificates ceased to exist 20+ years ago so have no legal value. By all means submit it with the form DS1/DS2 but if you do we will simply destroy it. No Land Certificates will be issued

    Are we able to use the DS2 form that BM sent in 1999? I see the new style DS2 is in a different format and seems to require certified copy of ID. @Land_Registry

    You need to complete and submit a new DS2 and appropriate ID verification
