UC AND CHILDS ACC

Hi im.on UC joint claim partner working FT me  a carer receiving UC CA dla for rhe child. I have an isa from when we were on TC ...I been putting Hythe child dla into the child isa..
Does this account as deprevation of assest for UC. 

Also i will be recievibg a payment fir personal injury soon... does this need to be declared and what effect does the 52 week disregard if applied mean to monthly payments...
What can I spend the money on do it don't count as deprivation of assets....howvfo they decide?.. 
I need a new kitchen I was going to use it for this and pay of 2 debts on my credit card.

    Personal injury compensation is disregarded for 12 months. 
    Officially you do need to declare it yes. 
    You can spend it how you like.
    After 12 months they won't check up and ask what you spent it on.
    The only relevant thing at that point is if any remaining money takes you over £6k of capital.

      Officially there is no need to declare it as it's disregarded for 12 months by law so will have no effect on benefits. A person might think it's wise too, but there is law breaking if they don't.
    The 12 months can be extended indefinitely in the PI is held in trust.

    Your ISA is your money,  your child’s ISA is there money.  If you are receiving X amount from DLA and transferring the same amount to his ISA then that’s ok.

    If you were to get to up to around £6K in your ISA, and then you transfer £3K into your child’s ISA this may be questioned.  

    As already noted your compensation payment will be disregarded for 12 month.

    The threshold for UC is £16k, not £6k.  £6k is the point at which UC will be reduced, little by little.

    The threshold for deductions is £6K and this is the point that a claimant needs to start declaring their capital.

    For OP and general readers, the deduction is £4.35 per £250 or part of there in, over £6K

    Some has said i can't put my child's dla into her isa as it's dep of assests and im.not using all of it on her ?
    I don't know if this is true ?

    Also do they have direct access to accounts?,when I applied for uc I'd migrated from tax credits so they just checked ID no bank statements... im presuming they'd check them remotely....

    No it’s not true, DLA is in your child’s name and so its not classed as yours.  Equally it’s not attached to a specific reason eg here’s £20 for up keep of a wheelchair.  The money is not means tested so you can earn £2k a month and still have DLA.  So what you do with that DLA is up to you and your child.  Putting all of it, or some of it into an ISA is somewhat protecting your child’s future.

    Not always the case, you should have declared what accounts you have and the amounts/ balances in them, on application. You will only need to then start declaring your capital once you’re over the £6K.

    No, DWP have no access to your accounts. It is your responsibility to declare your capital if it exceeds £6,000.

    The only thing UC does have access to is your earnings from employment, so if you are working you generally do not need to declare your earnings each month, but they receive this from your employer via HMRC, not from your bank. Maybe you were getting confused with this?
