Parking ticket gone to court

  • I did send the witness statement, with the main point being about Chan and Akande and the POC. I put them into the exhibits also.
    I have contacted them to see if the hearing is going ahead, when I called them they say it is still listed but they can’t confirm so they advised me to email the court but no reply and it’s been about a week. I did list the email as urgent. They told me on the phone to assume that the hearing is going ahead but to call in the day before to confirm it is still listed as going ahead if no reply by email.

    The Chan & Akande point is your preliminary matter. You are FIRSTLY asking for the claim to be dismissed on that basis.

    However:

    Obviously you don't go in without copies of all the paperwork, or a charged laptop with both WS and exhibits easily findable on it, so you and the judge can follow the same page numbers if he/she wants to go through it all.

    We can't be sure whether the judge will immediately agree with your preliminary matter. Try it first and point out the C hasn't even attended, so that plus the poorly pleaded claim is a clear and vexatious abuse of the court process.

    But expect a judge who wants to look at the evidence. Be ready.

    Don't forget to ask at the end, for £95 for a day's loss of leave, plus travel for court. Don't be shooed out. Ask for your fixed costs at least.
