What does the retailer state as the applicable law regarding your contract?

Assuming the Consumer Rights Act 2015 applies, then if they sent the wrong item they are responsible for the return costs.
Have you made it perfectly clear to them that you are returning the item because they sent the wrong one, and that you aren't just using their own returns policy?
If the Consumer Rights Act does not apply (eg the seller is based in a foreign jurisdiction) you may in effect have no rights.
Who is the seller?0 -
I suspect you've bought from a Chinese seller, and spending money to send the item back is only going to cost more money for no return.
Once we know the answers to the questions posed above, we'll know what the best course of action will be. If it's a Chinese retailer and you bought from an ad on tiktok, or similar, then your best bet might be to wangle whatever partial refund you can from them.1 -
This is one of the most common topics we get on here, buying from Far East companies and getting the wrong or shoddy goods. The adverts are usually seen on social media or are unsolicited emails .Ballerina60 said:Ordered an item for christmas wrong item was sent emailed there custmer services to inform them of the mistake, they stated that faulty or returned goods would be at the customers expense but as they sent the wrong item in the first place surely thay are at fault ,A s it came from china they want me to return it back at my cost and then a refund will be issued .What are,my rights .ThankyouIf you try and return it to the Far East it will never show as delivered so you would be further out of pocket for the postage. It’s best to keep on at them and see if they will offer a good will gesture of a part refund. Some people have had success with being offered up to 30% refund.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. If, however, your purchase was from China, you may have few routes to enforce anything.1 -

Odds of it getting to retailer. Slim to none.Life in the slow lane1 -
I agree, I wouldn’t even waste money trying to return it and I stick by my original advice to try and negotiate as high a goodwill refund as possible.born_again said:
