If company rejected the chargeback, then CC has a max of 28 days to respond to contest the contest. It's a pre arbitration & then Visa/Mastercard sit as Judge & jury on the case.Charsiu said:
Their response letter was dated 11 November, by the time I retrieved the letter I replied by email by 11 December, I think this is still within the time limits of the MC guidelines (which I know the credit card company doesn't have to align with) so they could have continued with the case, but did not due to internal process - I intend to raise this with the FOS once I have their final response letter.born_again said:As this is a chargeback & card regulations, there is nothing Fos can do.
Yes, raise a complaint, might get a bit of goodwill from the bank.

So no you were not in the timescale. Sorry.
Your CC do have to align with card providers regulations & timescales. It is part of the agreement they & retailers sign up to.Life in the slow lane0 -
The thing is you need actual grounds, a rational, legislation backed reason why the card company should pay you out of their own pocked as otherwise you are just wasting everyone else's time and money.Charsiu said:
The chargeback (with Mastercard) is done and dusted as it's closed. The FOS complaint would be for the credit card company's handling of the case; it's a clutch at straws, sure, but I have already lost a grand already as it stands.MattMattMattUK said:
On what basis? Chargeback is not covered by the FOS.Charsiu said:

If you are going to do anything then send Prestigia an LBA, get a CCJ, register it in Gibraltar and then enforce it (which is actually not that difficult against a company based in Gibraltar), anything else is just wasting other people's time and money.0
