    I subscribe to a number of motoring forums and have also witnessed many speeding prosecutions in court. I have never seen a verified case where enforcement has been taken below the guidance threshold.
    Well my ex-boss must be unlucky as i was talking to him today and he got done for doing 75 mph on a motorway so 5 mph over the limit, he got a Driving awareness course but no points.
    Motorway limit could have been lower than 70 when he was caught.
    Would he have been offered a course doing 75 in a 60
    10%+9 is the guideline for courses, so a course will be offered for speeds up to and including 75 in a 60.

    Yes they would usually offer a course for that unless there was some reason not to.

    No it was 70mph.

    If the Limit + 10% +2 is ok then always driving at 78 mph on a motorway will be ok as 1 mph under the limit for a conviction.

    It isn’t OK. The limit is the limit. The police do not normally take enforcement action below (Limit + 10% + 2mph) for reasons that are explained in their guidance document that I provided. But they can if they want to. 

    …driving at 78 mph on a motorway will be ok as 1 mph under the limit for a conviction.

    The limit for a conviction is not 79mph. That is the threshold below which the police will not normally take action. But any speed above the limit is sufficient to secure a conviction provided the police have evidence to satisfy a court that an offence was committed.
