motor ombudsman
We've been waiting ages for the motor ombudsman - we've now waited longer than what they said it should take - probs over 18 months. I called recently and was toild the volvo dealer had replied and they were waiting to attach adjudicator. they did say they would prioritise us, but still not heard anything.
We had a catastrophic failure on our volvo and it did around £10k worth of damage, 3 months out of warranty on a non-serviceable part (as we were told by Volvo at the time). We ended up with them offering to pay £8000 and we had to pay £2000 which we had no choice but to accept as we only have one car. So we are hoping tor recover more of the £2k we outlayed.... it is not a small amount of money, and we had to fund it with a credit card.

What is the basis of your claim? How long has you had the car before the fault occured? What was the nature of the failure? Is there a question?scootar said:We've been waiting ages for the motor ombudsman - we've now waited longer than what they said it should take - probs over 18 months. There is no question in the OP. Maybe it is for information only: Motor Ombudsman cases are severely backlogged.1

Sorry, I think I said but the fault should not have happened is the main basis - according to Volvo themselves. They are acknowledging this by covering £8000 of the cost. It has been nearly 2 years. I guess the question is 1) whether this is normal to wait to long. And 2) Do we actually have any chance? I am not sure how often people get money via the ombudsan. And then do we have a case? It was something to do with the rear axel and that going into something else and causing more damage I believe.
this was 5/7/24"The car experienced a catastrophic failure, shortly after the warranty period ended. The failure was caused by an unserviceable part. This part should last much longer than 3.4 years and should not fail - especially on what is a low mileage car with a full dealer service history .Pursuant to the Consumer Rights Act (2015), there is an implied term of the contract I have with Volvo Uk that goods be as described, fit for purpose and of satisfactory quality. This failure should not have happened: the car was not fit for purpose and not of satisfactory quality. As you are in breach of contract, and we have owned the product between 6 months and 6 years, I am within my statutory rights (CRA 2015) to ask for it to be repaired without charge.I will give you the chance to reply to this before I refer this matter to the Motor Ombudsman. You are side stepping the part where they can take into account & charge for you usage of the car over the 3 years you had it.scootar said:Sorry, I think I said but the fault should not have happened is the main basis - according to Volvo themselves. As it was over 6 months did you get a independent report on the problem?
So asking you to pay £2K out of £10K is a good deal.
Given you have come so far, you may as well just wait it out & see what ombudsman decides, when they get around to your case.Life in the slow lane0 -
Have you checked the address of the motor ombudsman. It's the same as the Society of Motor Manufacturers and Traders. So the people who make cars and sell them pay thousands of pounds to be a member of this society. This society then runs the motor ombudsman. Do you expect them to order their members to pay you money? It's a strange arrangement to say the least.0

I love the way you say that like it's some top-secret conspiracy you've unearthed...Ibrahim5 said:Have you checked the address of the motor ombudsman. Shock horror: The SMMT own and operate the ombudsman!

That doesn't mean it's somehow rigged...
They're accredited as an ADR body by the Chartered Trading Standards Institute. Or are they in on it, too?
Don't you think it's actually in the interests of the industry body to try to ensure that members of that industry aren't incompetent and/or corrupt?
Yes, yes, I know, I know - you repeatedly state that every single garage is both of those...
Get invested enough into a conspiracy, and everything that should give you a nudge back to reality simply proves that the conspiracy is even wider... No wonder they rarely travel alone.1
