    Could you let us know the particulars of claim Horizon used?

    Letting us know your surname would also be useful. That way people with similar Horizon claims could use your Order in their defences ie. they'd cite Smith v Horizon. 

    Wouldn't set a precedent, but would be persuasive.


  • One thing I couldn't understand was the claim for "£80 for the PCN, £70 contractual costs.."  The signage, in it's sun bleached glory, references a £70 Parking Charge Notice.  I assumed that in the event of a court hearing they would simply ask for the claim to be adjusted?  Perhaps other locations are signed as £80?

    They cannot have a sign stating £70 (this is the alleged contract you entered into) and then claim it was £80 in court, as far as I have seen Tesco/Horizon signs all say £70 even now.
    Those Particulars of Claim are totally inadequate, no wonder it was thrown out.
    The signage photo is dreadful obviously old and out of date, it won't be there now I would bet.

    Nothing new! There are several examples here of Gladstones / Horizon claims ALWAYS being exaggerated by a tenner:

    I think it is because Horizon add a tenner after the first month, and thus, I think ALL their cases are always wrong by £10 when the software transfers to Gladstones.

    Who clearly cannot be bothered to put it right and are making extra money for no reason in every CCJ case paid.

    This is good news, encouraging to read a successful outcome. 

    Your  POC is practically identical to mine, other than its a different Tesco !! and they've somehow managed to make your interest a pound more than mine with the same interest rate !

    But unfortunately the hearing is going ahead for next Monday  

    The driver of the vehicle with registration xxxxxxx the 'Vehicle") parked in breach of the terms of parking stipulated on the signage (the 'Contract) at TESCO Bridgend EXTRA (2154), on 23/12/2023 thus incurring the parking charge (the 'PCN"). The PCN was not paid within 28 days of issue. The Claimant claims the unpaid PCN from the Defendant as the driver/keeper of the Vehicle. Despite demands being made, the Defendant has failed to settle their

    outstanding liability. THE CLAIMANT CLAIMS £80 for the PCN, £70.00 contractual costs pursuant to the Contract and PCN terms and conditions, together with statutory interest of £16.58 pursuant to s69 of the County Courts Act 1984 at 8.00% per annum, continuing at £0.03 per day.
