Insurance claim

hi all.
i recently made a claim on my home insurance for my wife's eternity ring. insurance provided a new replacement ring of choice which was was great at a cost of approx £2k. a week or so later i received a cheque for just under £400 with a a letter all addressed to me. I assumed this was part of the settlement so paid money into the back. fast forward 2 months and the insurance are call to say the cheque was meant to be sent to the jewellers, and would like the £400 returned. they have admitted it was human error and should not have happened.
i am trying to figure out where i stand with this as i no no longer have the money.
since they are have admitted the error should they not be liable? and no reason for me to think it was not part of settlement.
any advise is welcomed.
thanks

An error's an error, they're entitled to the money back.

If they had sent you £400 too little in error, do you think you wouldn't be entitled to the balance?

Unfortunately they are entitled to it back but given it was their error they should be reasonable in terms of its repayment so make a reasonable offer of repaying £X per month or whatever is reasonably affordable for you.
  • Send the ring back and keep the £400.
  • What did the letter say?
Ultimately though if it was an error, it'll need to be paid back.
