Park and Control Fine

Hi All,

Hoping for some advice/ help. 

I parked at the car park in Hertford Bircherley Street, SG14 1RL on 30/09/2025 for sub an hour. 

While i was there i found no clear ways to pay to park, its not a ringo or paybyphone site, no gate payment machine and the only machine i found was with a black screen and appeared to be non functional. 

There were two signs, one saying "this is a pay at exit" and the other saying "this is not at pay at exit" car park. 
I appealed the fine stating this with supporting photo evidence. 

They sent my appeal response via email only to a misspelt email of mine meaning I did not receive any form of response until a Debt Recovery Plus letter came through at £170. 

In the response they stated their signage was fine and that they had contactless means to pay as well as via phone. 

There were neither of the provisions stated available and the signage made it very unclear on what the payment means were.  A look on google and you'll find this is a common thing at this car park.

Debt Recovery Plus were the ones to disclose the reasons for the refused appeal as Park and Control have no customer service or any non automated machine and do not appear to send out correspondence via post. 

I have gone to the IPC with my appeal and will await their response. 

I have very clear photo evidence of two signs stating very different things and neither what was actually available at the car park to pay with. 

I cant contact Park and Control to start an IAS appeal as they don't have customer service just a series of numbers for robots. 

Could i consider going to court ?

    they can issue a claim against you though

    Hi, i meant by court waiting till they apply for a CCJ and then display the evidence then to whatever civil centre they try and CCJ me at. 

    DRP i wont contact again i just had to as the Park and Control dont have anyone. 

    I guess IAS or IPC are a waste so its just a matter of pay £170 or wait till CCJ?

    You won't automatically get a CCJ.
    They may request a court hearing and you can follow a well documented process to defend it.
    Only if you lose or don't bother contesting it will there be a CCJ requiring you to pay (and only if you don't pay within a month will it appear on your credit score).

    You won't automatically get a CCJ.
    They may request a court hearing and you can follow a well documented process to defend it.
    Only if you lose or don't bother contesting it will there be a CCJ requiring you to pay (and only if you don't pay within a month will it appear on your credit score).

    I would presume by now that the chance of a CCJ is quite high, I have those two photos as posted, would that be enough in its own right for a defence then at court level ? or would I lose again then as they seem to have full control so far, soon the sum will be £280

    Sorry you are wrong on all counts there
    There is zero chance of a  CCJ if you follow this forum
    owned by APCOA so unlikely to get a claim
    please follow the advice i have already given

    Definitely not a fine,  just an invoice from a private parking company 

    The claimant could issue a Money Claim. ( not a CCJ. )

    Do not pay

    Follow the advice above,  ignore the powerless debt collectors letters , they cannot do anything 

    Don't overthink this,  but do learn about the topic by reading the official MSE advice on this website,  and study the newbies sticky thread in announcements near the top of this forum too

    You are wrongly thinking that a Claim Form is a CCJ. It's not!
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    And for future reference never ever ever use words and terms like I did this, or anything else that may identify the driver. you have used the I word far too many times.
     
    For a vehicle you can have ( at least) the following 
    • The Owner
    • The Registered keeper (the person/entity tat recieves the stuff form the DVLA) 
    • The Hirer ( if its a hire or lease vehicle)
    • The Driver on the day 
    All of the above can be different people/entitys and if the pakring company has not complied with the protection of freedoms act (PoFA) then the registered keeper is under no obligation to identify the driver and the parking company can foxtrot oscar.
     There are a few cases where this is irrelvant suhc as own space, "double dips" anpr errors and so on, but as a rule of thumb never ID the driver.
     Its not fatal if you do name the driver, but it can make things a little harder to resolve so you pay noting
