I'd email your legal department and ask if they can draft a letter demanding the invoice is dropped or face legal action as you had lawful authority under Section 111 of the Local Government Act 1972.

    Subsidiary powers of local authorities.

(1)Without prejudice to any powers exercisable apart from this section but subject to the provisions of this Act and any other enactment passed before or after this Act, a local authority shall have power to do any thing (whether or not involving the expenditure, borrowing or lending of money or the acquisition or disposal of any property or rights) which is calculated to facilitate, or is conducive or incidental to, the discharge of any of their functions.

Thanks, I think I'll quote that without involving legal dept. I don't mind the prospect of facing them in court and am very comfortable in court as I go with work.

I can't see how IAS won't also take this into consideration.

Because the IAS are all part of the scam there is no appeal their boss even tells brags to the industry they reject over 95% of appeals!

The IAS is just a load of rubbish, an invention by Davies (GLADSTONES SOLICITORS) and HURLEY

Simply the dregs of money scammers.

The case can only rest on the signage and how the public are told by signs and the boundary.
    DOUBT UKCPS can prove this

    JUST TOTAL RUBBISH BY
    UKCPS
  • So on the evidence they provided me there was no boundary map. Does there have to be one?

I can....... you really dont understand how these things are set up i am afraid.
But on the off chance it does get to court, surely I'm better off evidencing that I tried to engage and they are the ones being unreasonable.

The leaving site scam is an add on that some operators try on to drag every last penny out of a site, there is nothing to my knowledge in the joint COP about it and only one incident known that went to court which failed miserably and humorously.
But think about it; to succeed in a contractual claim the terms of the contract need to be perfectly clear up front and detailed, how can you know where the boundary is if it either isn't fenced, indicated or mapped?
But a couple of points, why haven't you complained to ALDI especially if you are investigating noise coming from an ALDI site, plan A is always the first action.
Is this actually a stand alone Aldi site, they invariably contract to Parking Eye not UKCPS?

Unless there is one, how does anyone know where the ‘site’ starts and ends? No parking firm has succeeded in winning such a case in court …. because there’s likely only ever been one … and as James says above, that ended disastrously for the PPC.

    It’s a try-on!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
