Had no time to look at your WS but did you get it emailed and cc'd to DCB Legal?
They'll discontinue next week, so get ready to proudly show us your NoD for the gallery!

Hi,
Thank you all for your help so far. I did manage to submit my WS in time and also emailed a copy to DCB Legal before the submission deadline.
The hearing fee was due to be paid the following day, which on checking with the court, does not appear to have been paid.
The court have now sent me an email stating that the case has been thrown out.
I'm just checking - I'm aware that the case is no longer going ahead which is already a huge win! However this does not seem to be a formal notice of discontinuation.
I have spent a lot of time learning about how these things work and preparing my defence/WS etc. Do people normally try to claim costs back, or would I be entitled to do so given that I don't have a formal NoD? If so, is there is a limit on what can be claimed?

I assume that you didn't add a counter claim when your defence was submitted, so as they have failed to pay the hearing fee then although you could write to the court requesting wasted costs, they are limited to small figures and probably won't be granted
FFrankly , you should take the win by default, the fact that its been struck out
Ps, just because you say that you have not got their N279 discontinuation document, doesn't mean that it wasnt sent, check your email inbox and spam folders for it

Email DCB Legal now, asking for their notice of discontinuance because they failed to serve it and you will claim costs if they do not.
DON'T MENTION THAT COURT EMAIL.
