do I pay off one debt first or do I try pay them off altogether

  • I asked in email to ACI for CCA, and a full and final, got nothing wrote a bad review on trust pilot, they now have got in touch and they want me to contact them to discuss the account they said there not willing to do a f&F as it to higher amount and that I need to pay the full amount and that they would do a settlement figure of £2k so I have been in touch with ACAS and FCA. They have stated that i can ask for all these things and the FCA have opened a investigation into this I said to them I would pay what I could afford. They said I should be able to pay on there records £474 a month to get the bills down, I said I had bills to pay and other debts. they just sent me information on getting a IVA.

    I think you might have misunderstood here the reason you ask for the CCA is because you DON'T want them to produce it it. The debt can't be enforced if they can't produce the CCA so the idea is that you leave it there and simply stop paying, you don't want to go chasing them for something thst would make the debt enforceable.

    CCA requests have to be made in writing with a £1 fee enclosed to make them valid.

    If it does turn out to be enforceable then they are perfectly entitled to ask for the full amount even though they would have only paid 10% for it. Agreeing a full and final settlement is a bit of game at they'll want to try and squeeze as much as they can out of you, so play hardball and try again in 6 months time if they don't agree to a reasonable figure.

    Send ACI a formal request for a CCA using National Debtline's template, there is a link to it in this article which explains more.  NB you have to enclose a £1 cheque or postal order so this cannot be done by emailhttps://nationaldebtline.org/get-information/guides/credit-agreements-getting-information-ew/

    Stop offering a F&F until you see if they can produce the CCA.
  • I decided to do the snow ball effect if its called pay my EE bill off first, I'm still waiting for my CCA agreement of ACI. I am thinking of writing an email to ACI for F AND F as it will be £1300 to owe them and that is manageable to pay off rather than the original amount they want.   
    Just wait for a response on the CCA request - no point in paying if they can't produce one. Do not chase them - it's not your responsibility.

    The only documents you are interested in from them are credit agreements. Statements, summaries etc are just chaff to muddy the waters.

    Don't be tempted to call until they send the CCA. Even then it's best to just set the payment up without consulting them - you decide what to pay them and do it, what would be the point of speaking to them?

    As tigergambit says these companies often try and muddy the waters to try and fool you into paying when the debt is unenforceable. . As an example they might send any old documents they are able to dig out, and then say that that concludes their response and that the debt remains "valid and collectable" (that's technically true, but doesn't mean that it's enforceable, but they are trying to mislead you into thinking it is) . 
  • There is also a little bit more information ACI and Likely loans who I got the loan originally from they call me the wrong name they call me Mr Todd which is not my name and I think in the past i have asked them to change this and they never did. So with this in mind it doesn't show up anywhere on files the old Oakbrook loan does for settled back in 2023 as that was the time it was sold to ACI who have had it since.

  • I'm worried that there is this debt with them and one day its just going to comeback and haunt me, do you ever get that feeling that its going to happen one day. They keep sending me letters and emails to pay the remaining balance, I am honestly worried one day there just going to either turn up at my house or my work or they will try and take me court. 

    They keep calling me Mr Todd but they get my first name right they have all my details so I am just worried, I know people are saying don't deal with them but it worries you when companies like this are breathing down your neck for money and are sending letters out or emails demanding money. The worrying factor of many.
