LPA refund

My wife and I are in the process of creating our LPA's and we decided to nominate each other as primaries and a couple of relatives as backups. We checked with all concerned and they were happy to sign.

As we were both doing financial and health (total of 4 LPAs) we decided initially to submit just one to ensure we had filled everything in correctly before paying for the remaining 3.

We paid and printed out the form and sent the backup LPAs there paperwork, this is where we realised we had made a mistake. We basically had so many issues getting the forms signed and returned to us that we decided it was probably best not to bother with backups.

I read that if I did not file the paperwork within 42 days I would get my payment returned, this is was I decided to do and then create new LPAs without nominating backups.

It's been 132 days since I paid and still no sign of the refund.

What can I do?

    It's always wise to have more than one attorney and/or back-ups. Your mistake was to pay for the LPA before you had completed the documentation, which does take some time, admittedly.

    All you can do is chase for a refund, assuming your refund claim is valid, which it would appear to be from your OP>

    Having just each other as your only attorney means one of the lPAs is definitely going to fail on the first death or if one of you loses mental capacity.

    If both of you lose capacity neither are going to have an attorney. So not the best of plans.

    I don't know if my experience will be of any help to you @baz8755.
    I submitted LPA documents for both health and finance on behalf of my lovely husband (with his agreement and signature obviously).
    Within 2 weeks of the submission, he sadly died suddenly and unexpectedly. 
    I emailed the relevant LPA folk to inform them of his death as, clearly, there was no point in them spending any time on it given the sad circumstances.
    I did not request any reimbursement of the fees as I assumed it was just one of those bad luck things in life that happen.
    Over 1 year later, a cheque arrived in the post refunding me for the full amount.
    I was quite touched that they had bothered and it restored my faith in officialdom a little.

    Probably not but if you have no-one you can genuinely trust it makes little difference

    Very sorry to hear of your loss, obviously at a time like this the fees would be the last thing you would be concerned about.
