POFA and PCN

Hi all, I have hired a car for 2 weeks in which I parked and with a good faith tried to pay for parking charge but the meter was out of order so neither cash nor card payments can be made and it’s proven in their evidences of pictures they have taken that the meter is out of order !! I was then issued with a parking fine which I see completely not fair and pure stupid greed. They sent me a letter after the hiring company passed them my details and it’s addressed to me without any other documentation like rental agreement or anything like this. Any advice please?

if I’m not mistaken, they are not POFA compliant and I actually worry about my rental company to pass them the papers as I’m not sure if the rental company know what they are doing.

Also, where’s the template that I can draft to send it to them please? And If I refused to say who was the driver, can they still take me to court or send bailiffs to me?

    Study the bottom section in the first post in the newbies sticky thread in announcements near the top of the forum,  looking at the Edna Basher advice, because I assume that you have received a Notice to Hirer pcn with no copy of the hire agreement enclosed 

    Name the private parking company claimant involved 

    No blabbing about who was driving 

    They could issue a Money Claim N1SDT pack against you 

    No bailiffs will call regarding a single pcn,  but if there were half a dozen then maybe in the future,  subject to numerous criteria, but not for a £100 pcn

    The private parking company is: Premier Parking Enforcement Ltd.
    So even they have no rental agreement paperwork, they can still issue me a Money Claim pack?

    Appeal as hirer,  stating that they failed to comply with Pofa2012 so you have no liability 

    See Edna Basher templates for wording 

    Dont explain why, do not reveal who was driving,  even if it seems obvious to you or to us, no admissions 

    Anyone can send anyone an invoice. ( which is what you have received above. )

    Anyone can issue a Money Claim against someone else for any reason whatsoever 

    The fact that they may be winging it doesn't deter them,  it's currently an unregulated industry,  anything goes in pursuit of profit,  in pursuit of money

    You are nowhere near a claim form and if it happens in 2026, so what really, because you will never pay.
