    I wouldn't consider those terms ambiguous at all.

    They only mention "use" and not "topping up".

    If the OP used the card in april then he has complied with the terms as he has used it within the last 12 months.
  • Hi everyone just want to say thanks again for all your help on this.  I had some IT issues so have only now sent an email outlining details of Section 69 as mentioned above.  However, I also done a bit more digging on the fact that I accidently selected refund to e-gift card in error and found the information below which may be helpful to others.  Given this I have said I am giving them the opportunity to correct their mistakes and for the remaining balance on the gift card to be credited to the original payment method.  It will be interesting to see what they come back with! Thanks again.

    In the UK, under the Consumer Rights Act 2015 and the Consumer Contracts Regulations, the retailer is legally required to issue a refund to the original payment method unless you expressly agree otherwise.

    Retailer Obligation:  The law states the trader must make the reimbursement using the same means of payment as the consumer used for the initial transaction, unless the consumer has expressly agreed otherwise.  If you select the gift card refund in error, not through express agreement to a different method, then the retailer should correct this.
