Replacement window contract

Please can someone give me some consumer advice please.

I had a local replacement window company out to quote me for some new windows. They were quite expensive but good quality. As I couldn’t afford to get them all replaced in one go the sales man split the order up into stages. Stage 1 I agreed too and paid a deposit for and they’re coming out tomorrow to fit them. Stage 2 he told me that by signing a two year contract with them it would hold the quoted price and I’d have 2 years to get them fitted in. He told me they’d be no other obligations and if I couldn’t afford to do them in that two year period he’d just come out and do a fresh re quote. I trusted him in what I was told and stupidly signed. The appointment was very pressurised and rushed but I put it down to he was busy and had other quotes to get out and do.

I googled the company today for their phone number so I could find out what time their fitters were coming out. I spotted their company had a two star review so started reading to which I then found out that to get out of the stage 2 contract I’d signed there was a financial get out clause. The windows haven’t been made up for stage 2 as I can’t afford them and now I’m really concerned as to what penalty I will have to pay.

The contact I have with them has been running now for 6 weeks as stage 1 windows haven’t had to be specially made which I will honour but having been lied too by the sales rep I want to cancel stage 2.

Please help as the company won’t let me cancel due to being very mislead and they’re extremely rude

What does your contract actually say?  Much better to read that than to rely upon what a stranger has said on a review site.

Who has lied, and on what basis?

You say they've been rude, which suggests you've been in contact with them about this?  How did that come about, and what did they say?

    Welcome to the forum.

Six weeks ago you signed up to a contract with a window company.
In the contract you both agreed:
    1. A fixed number of windows in total was agreed. An agreed portion of those windows would be fitted tomorrow (and you will then pay cash for them once fitting is completed?)
    2. The price for the remaining portion will be held for 24 months (so after 24 months they will fit the windows at the agreed price and you will pay for them after fitting?)
    3. If in 2 years time you are unhappy with today's quote (for example if the general price for new windows has come down) he will revisit and adjust the quote.
Is the above correct? If so it sounds reasonable to both parties.

As with all contracts, you can break the contract if you wish. For example, after the first phase of windows are fitted tomorrow you can simply say, 'I'm breaking the contract, I have decided I don't want the rest of the windows after all.'
Since this is a consumer contract, if you break the contract the window company can only claim whatever actual costs they have incurred as a result of your change of mind. If they have not yet made your windows to your custom sizes that might be just the time of their surveyor in measuring up and designing your windows, plus some admin costs.
However since you are happy with the quality and value of their products and they have agreed to hold the price for 2 years until you are ready for them to fit the second tranche, why would you want to cancel the job half done?
  • I think you're worrying about nothing.  Most companies only honour a quote for 3 months, because prices always go up.  To get 2 years grace at today's prices is a good deal.

If you were confident of saving up enough money to pay for the next batch of windows, then nothing really has chnaged has it?

I do get where the anxiety comes from; no-one likes signing up to something expensive in a rush, especially if they feel pressured.  But it doesn't sound like they have done anything wrong, and have been more than reasonable in terms of pricing; that is, if they're not over charging you massively.  You said they were expensive - did you get any other quotes?  If not, what are you comparing it to?
