[ParkingEye] Should I attach gym membership to complaint/appeal?

    I wouldn't say "either" describes it any more than a printed ticket of all the possible reasons but none of them are ticked.
    Personally I think giving them the reason for issue is a bit daft. Even our OP isn't 100% sure why.
  • Thanks for the help all. The complaint to EveryoneActive has gone out, hopefully that nips it in the bud before having to appeal to PE. Although as per @Coupon-mad's advice it might just be worth ignoring? What about the copy/paste first appeal text as per the NEWBIES thread?

    Although - I'm happy to go all the way - I'm not paying!
  • If you’ve already put a complaint in with EveryoneActive, that’s the right first step — they’re the landholder and PE can only back down if the principal tells them to. Quite a few of these get cancelled that way.

    On the ParkingEye side of things, stick with the first appeal text from the NEWBIES thread. Don’t add anything extra or try to explain the “why” — PE just look for reasons to reject or twist what’s said, so the standard wording is safest.

    Definitely don’t ignore it though. That changed years ago and only makes things harder later on. The usual pattern is:

    1. Complaint to landowner (you’ve done this)

    2. Initial appeal using the template

    3. POPLA appeal if it gets that far

    Most PE tickets don’t survive a strong POPLA appeal, especially where there’s a gym contract involved.

    Interesting post for a newbie.

    I agree with everything except your final paragraph. I do not see gym cases ever won at POPLA. ParkingEye usually win at POPLA but so what because they tend to lose in court claims because DCB Legal handle most of them and discontinue.

  • Well. No need to worry about the appeal - Everyone Active have cancelled my parking charge. From them:

    Hello [name]

    On this occasion I have cancelled the charge.

    Charges are normally issued if a number plate is not entered, not entered accurately or you have gone over the time allowance of 2 hours in the car park.

    A polite reminder that it is the motorist's responsibility to ensure the number plate is entered correctly into the terminal located on the reception counter. We have certain restrictions on waiving charges, so we are only permitted to waive one charge per customer. I would like to highlight the importance of accurately entering your number plate to prevent another charge being issued. If you wish to track the progress of your charge, click on this link and enter your PCN details. https://portal.parkingeye.co.uk/

    I assume that last one waive per customer rule is nonsense.

    Here is what I wrote to EA if people in the future are looking at this thread wondering how to fight a similar case themselves:

    I'm extremely angry and disappointed to see that I have been issued a £80 'parking charge' by your Private Parking Enforcement Company, ParkingEye.

    They have given me no specific reason as to why I have breached any terms of conditions. They have only included a list of possible reasons as to why I’ve been issued the charge – including not purchasing a pay and display ticket, which is impossible to do at the car park.

    They mention that the car park is for patrons only, however if you look at my booking history with my membership number below, you can see that I am booked in for a session so my reason for parking is legitimate.

    I politely request that you write to ParkingEye to request that this parking charge is cancelled. Otherwise, I will have to cancel my membership as factoring in parking charges using the pool is more expensive than others in Stevenage.

    I'd be interested in the GDPR ramifications of this setup. You might want to prod Everyone Active and ask more about this passing of personal details and whether they have a database they share with PE.

    But in any case Parking Eye should now not hold your details on file. I'd dpo@parkingeye.co.uk and instruct them to ERASE any details they hold on file for you under the GDPR.
