DVLA SJPN/ PCP Car collected months earlier, trader filled V5C but DVLA still prosecuting

Hi all,

Hoping someone can help, I’ve read a lot of threads here about DVLA issues, but none quite match my situation.

I’ve received a Single Justice Procedure Notice for “failure to comply with insurance requirements” (Section 144A RTA 1988). DVLA claim I was the keeper of the vehicle in 06/2025, and it wasn’t insured.

However:

What actually happened

The vehicle was on a PCP which ended in Feb 25.

It was inspected and collected by Manheim in February 2025.

The Manheim rep completed the V5C motor trader section at handover.

After that date I had no possession or control of the car.

The finance company confirm in writing:

“Our records confirm that your vehicle was returned on xx Feb 2025.”


Evidence I have

Manheim collection/inspection booking email

Manheim inspection report with Feb 25 collection date and my signature

Finance provider letter confirming the return date

Scanned V5C trader slip completed by Manheim (which I completely forgot to send to DVLA !)


No earlier notice received

DVLA claim they sent a Fixed Penalty Notice in June. I never received it.

This SJPN is the first communication I’ve had.


My questions

Should I contact DVLA Prosecutions with this evidence before entering any plea?

Would this typically be grounds for DVLA to withdraw the case or offer an out-of-court settlement?

If it goes to court, is this a valid statutory defence (I was not the keeper on the alleged date)?

What is the best approach based on forum experience?

Apparently, some people have had success emailing DVLA directly (via prosecutions@dvla.gov.uk or dvlaenforcement@dvla.gov.uk) so I am thinking of doing this first.

Any guidance from people who’ve handled DVLA enforcement or SJP cases before would be very welcome.
