Azure Appeals Page

I have read the FAQ's and am going to lodge an appeal, however I have a question about how to do that.

On the web page for Azure Parking, they now explicitly ask you if you were the driver. I do not plan to admit who the driver was, so should I put no? If somebody did put no but was the driver, would that cause problems later on?

I did find a generic contact email on the website - maybe I should send the appeal notice there instead?

    It's a two bit parking company if their NTK is fully compliant it doesn't make much difference, but what ever you put they will reject it anyway.

    Don't bother with the farce of 'appeal' (OBVIOUSLY TOTALLY IGNORE AZURE PARKING) but show us a screenshot of that page please, and the URL.

    This never used to be allowed by the BPA so please complain to Azure and then the BPA to get it changed.

    The DVLA and BPA issued a communication years ago that operators CANNOT make appeals appear reliant upon the keeper having to say if they were driving or not.

    It's typical ZZPS scam conduct (just look at their Trustpilot reviews!) to send a keeper a notice saying they're liable under the POFA, yet refusing their right to appeal.

    Have they also added £1.95 (an illegal payment surcharge) on the back of the NTK?

    A keeper is perfectly entitled to appeal.

    Here's the BPA and DVLA's stated position on this (thanks to Siross for this useful DVLA email). It is not allowed to appeal to make appeal conditional upon saying who was driving:

    That was 11 years ago by David Dunford at the DVLA.

    Reiterate in the your complaints to Azure then the BPA that you are the registered keeper and are perfectly entitled to appeal.

    Show them David Dunford's email from 2014 and ask the BPA if they are happy that their operators' (and ZZPS') conduct has declined into the mud since the BPA got into bed with the IPC. Are they proud that ZZPS mislead keepers and block appeals? Utter scam behaviour.

  • I had a feeling that wouldn't be allowed. I will put in a complaint to both about it.

    Just realised I didn't include the URL: paymyparkingcharge.com is the site, but you won't be able to see anything beyond a login page.

    Do I just ignore the NTK then?

    The letter I had actually does not mention POFA. I can't take a photo right now, but it says the part about they may be able to recover the charge from me, but it no longer mentions POFA at all. (I've read these forums extensively and seen other examples of Azure letters that did mention it).

    Considering the nature of the business park, it's absolutely ridiculous that they're only using entry/exit to determine overstaying to start with. The majority of businesses there are mechancics / body work companies so you'd expect a fair proportion of the vehicles entering to not even be "parking" but in garages being worked on. 

    Would it not be a valid defence to point out that they've not actually proven I even parked in the areas they are "responsible" for, therefore there's no evidence I even entered any agreement with them that they can charge me for?

    Did try to contact someone in charge of the business park but just kept getting sent in circles so gave up that route.

    (Sorry for waffling a bit - the intricacies of this actually interest me).

    Yes. Didn't realise that was illegal...
    I think it could be. As well as exceeding the maximum sum in the Code of Practice, too.

    By complaining you aren't ignoring it.

    Your complaint should be that you "wanted to appeal and I'm the registered keeper but poxy ZZPS is making appeals conditional upon saying if the appellant was driving or not. This conduct blocks the keeper's legal right to appeal and was banned jointly by the DVLA and BPA eleven years ago (show the BPA David Dunford's email and ask why the BPA have gone to pot since Steve Clark retired and they climbed in bed with the IPC)."

    Be pushy. This should have been stamped out by the BPA.
