VCS "No Stopping"

    Some years ago, @Fruitcake (I think it was) went to town on the VCS van forcing motorists to stop and then issued them a PCN using the van mounted ANPR camera!

    Quick question

    I’ve obtained both the main contract and the later Addendum between VCS and Bristol Airport.

    The main contract contains a vague line about "parking and stopping control"

    Contract
    “VCS will provide
    parking and stopping control services at the Airport.”
    (No definitions, no tariffs, no contraventions, no stopping schedule.)

    However, the Addendum (signed later) contains the actual enforcement instructions, and it covers parking only.

    Addendum
    "This Addendum sets out the
    operational instructions for parking enforcement."
    "Contravention Codes: [all listed codes relate to parking]."
    "Tariffs applicable to parking enforcement are as follows: …"
    "The Enforcement Scheme applies to parking control in designated areas."
    (No mention anywhere of "stopping", "no stopping", "red route", "drop-off", etc.)

    So does the Addendum (being later, specific, and the operative instructions) effectively mean VCS have no contractual authority to issue "no stopping" charges at Bristol Airport?

    It will be up to a judge to decide/interpret.

    I acted as a McKenzie Friend for a poster who tried the, "stopping is not parking/Jopson v Homeguard persuasive appeal case applies," in a Bristol Airport case, but the judge was having none of it. He even ignored the fact (did not believe) that the signs in VCS's witness statement were at a different location to where the alleged events occurred.

    It wasn't the (incorrectly marked) camera van that forced motorists to stop. The van did however record motorists stopped due to a broken down bus, a vehicle stopped at a stop sign, a vehicle stopped at a roundabout give way sign, and vehicles stopped outside the area where VCS were contracted to operate.
