Convenyancing lawyers

I’m really distressed and need some advice. My conveyancing solicitors (Cambridge Solicitors LLP) gave me a CON29M mining report but never properly explained the risks, and I’ve now suffered a financial loss because of it.

I complained, but they’ve denied any wrongdoing and their reply felt cold and defensive. I’m waiting for their final response so I can go to the Legal Ombudsman, but the stress is overwhelming.

Has anyone been through something similar? How long did the process take, and did you get a fair outcome? I just need some reassurance right now.

    What did the report say?

    If you did not understand it why didn't you get further advice?

    How have you suffered a financial loss?

    Did they send you a copy of the search?
    What questions did you raise on it?
    Did they respond to your request for further explanation at the time - and if not, why did you not chase this up then?

    A solicitor isn't qualified to explain the risks associated with a mining report. But they should have drawn to your attention if it flagged something up as an issue and recommended you to take advice from your surveyor. Did they do this?  What was flagged up that you didn't understand?

    so a few members of my family and I chipped in and brought a property, My nephew did the main dealing of it. from what I understand the risks were not explained, and nothing in writing

    What did the mining report say?  Large parts of England include old coal mining workings. Damage from these is rare and is fully covered by the Coal Authority. It should not be a concern.

    There is more than one lender.

    No one can give advice unless you reveal what is in the report, and what was reported to your family.

    People are quick to say they weren't told this and that, but the vast majority of the time, they were, they just didn't bother to actually read their property report.

    Thankyou for all your comments. It took me a lot to come here.  It is no joke loosing a significant part of your savings, it mentally and physically distressing. if only helpful advice is given I would be greatful. Noone goes to to make a significant purchase, - then to face a great loss

    isnt the point the point of of hiring, a conveyancing lawyer- for them to explain the risks, and to clearly warn you against them?

    The thing is, the conveyancing lawyer will send a Report on Title to the buyer (your nephew?), when they have concluded their findings.   You would have signed to accept the Report and that you understood the advice given to you.  I don't know any conveyancing firms that do not do this. 

    You will need to look back at the paperwork sent to you (or your nephew) when you bought the property and read this report to see what was advised to you in regard to the mining report and other searches.  Bear in mind the solicitor is not a mining expert and their advice would usually be limited to state that you might need to commission further reports to investigate anything raised further.
