    I have received this email from Bulk Litigation:

    Having reviewed the content of your defence, we write to inform you that our client intends to proceed with the claim.

    In due course, the Court will direct both parties to each file a directions questionnaire. In preparation for that, please find attached a copy of the Claimant's, which we confirm has been filed with the Court.

    Without Prejudice to the above, in order to assist the Court in achieving its overriding objective, our client may be prepared to settle this case - in the event you wish to discuss settlement, please call us on 0203 434 0433 within 7 days and make immediate reference to this correspondence.

    If you have provided an email address within your Defence, we intend to use it for service of documents (usually in PDF format) hereon in pursuant to PD 6A (4.1)(2)(c). Please advise whether there are any limitations to this (for example, the format in which documents are to be sent and the maximum size of attachments that may be received). Unless you advise otherwise, we will assume not.

  • @Coupon-mad hi, sorry about thw last post, i can see that it was part of the 8 steps. I have however, just had an email from the tribunal courts with the following:

    Good morning,

    I am returning your response as your defence has been struck out (removed from the record). 

     What you can do if you have a judgment against you

    If you do owe the money, you’ll need to pay it back. If you cannot afford to, you can ask to:

    • Change the terms of (‘vary’) the judgment
    • Pay it back in instalments

    Find out what options you have for paying the judgment.

    You can apply for the judgment to be cancelled (or ‘set aside’) if:

    • You do not owe the money
    • You did not receive, or did not respond to, the original claim from the court saying you owed the money

    Steps to cancel or set aside:

     

    • Fill in an N244 Court Application Form completing sections 1,2,3,10 and 11.
    • In Section 3 you should ask for ‘Judgment to be Set Aside’ and give reasons why you don’t owe the money. 
    • Email it to Applications.CNBC@justice.gov.uk
    • Pay the court fee by Credit/Debit card, by calling our Helpdesk number Mon - Fribetween 9am and 3:15pm. Court fees can found by clicking this link Civil court fees (EX50) - GOV.UK

     

    Please note, an application to set the Judgment aside is not automatically granted and the outcome of it, is the decision of a Deputy District Judge. You’ll have to go to a private hearing at the court to explain why you do not owe the money.

    You will be given a Help with Fees, ‘HwF’ reference number which you need to clearly note on your application form.

    Does this mean it’s game over and I have to pay or go to court?

    Apologies if this is in the steps but it doesn’t seem to be!

    Login to MCOL and take a screenshot of your claim history and post it below

    Did you receive an N180 DQ document pack in the post ? If so , when..?

    Did you email your DQ to the wrong place? Or did the CNBC lose it?

  • I have no idea why, this email was a response to my email sending the N180 DQ questionnaire back.

    I don’t have a login for MCOL, so I’m not sure how to check?

    How would I know if CNBC lost it?

    You have not come back here for further advice for 3 months, in fact not this year !

    You never told us that you did not or cannot use MCOL ( everyone else is using MCOL )

    How did you submit your defence ? _ Email or post ?

    Did you date and also sign the defence ?

    What deadline was the N180 submission ?

    What date did you complete the downloaded N180 pdf document and emailed it to the DQ email address ?

    Did you receive the email auto response back from the N180 submission ?

    Clearly they responded to you previously sending the N180 DQ document on 23rd March

    You will have to phone them up ASAP if you cannot login to MCOL

    You must have put your defence in via MCOL? You have a login password on the Claim Form.
