UKPC PCN Not Parked Correctly Within Markings

Registered keeper received this PCN in the post after the period of the reduced £60 fee (keeper lives in a new build and only gets post a few times per week),

Driver had a newborn baby at the time and the car is a 3 door car and there were no parent/child spaces available after driving around multiple times and waiting for people in a car (who didn’t have a child) to leave the space but they didn’t, so parked as pictured and left enough room on the passenger side to get the baby out of the car.

Appreciate that having a baby isn’t an excuse and in hindsight, the driver probably should have parked in a way that the chevrons were on the passenger side to make it easier to get the baby in/out of the car but didn’t think this would be an issue at the time! 

Is there any grounds for appeal on this one by any chance?

I have taken photos of the front and back of the notice - please excuse the damage, it was retrieved out of the bin!

  • Update: I have emailed the land owner as per the Newbies thread. I couldn’t find any contact email other than the generic info@britishland.com so I have asked them to forward me on to a contact who deals with Preston Capitol Centre (I found that another customer was successful on another thread)

    I will keep this thread up to date with any correspondence but would be hugely appreciated to get some guidance on whether it’s worth appealing to UKPC as I only have around a week to do so (within 28 days)

    Hello! Yes I did read the newbies thread before posting but I wasn’t sure if the template on there would be relevant

    Please could I double check that this is the template to use (below) and would be still ok to use given that the PCN relates to parking outside markings rather than anything to do with overstaying or a PDT machine?

    When I log on to UKPCs portal with my PCN reference, there are more photos of my vehicle and the signage. I’m heading over to the retail park today so will look to see where the signs are situated as it’s not very clear on their photos. 

    I managed to get through to the correct person from the retail park management company but haven’t yet had a response via email on whether they’re able to assist and time is running out so it’s looking like I will need to appeal it.


    Re PCN number: 

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

    If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

    The "discount" early payment whatever should be seen as a ploy to get people to panic and either pay up, or nominate a driver who may not have been driving before taking the time needed to look at what exactly they have 
    Any complaints to the landowner should always mention that the parking company is un regulated, ie the  un regulated parking company, UKPC and tht they are jointly and severally liable for the actions of their agents .
     So instead of:
    please can you ask your agents, the un regulated parking company UKPC to cancel  this ridiculous parking charge notice

    As for nonsense like this, if you get anything in the post that demands money from you, research it to see what it is, take action where required (even if this means telling them to FO but in a few more words) and keep it somewhere safe for 6 years

    If the appeal you found and posted above was written in blue, then it is correct.  Do not be tempted to add anything to it, the standard appeal has been written to show them you have found the MSE guide and they should give up; they won't but you have started the ball rolling and you have, if it comes to a claim shown that you have tried to narrow the issues.

    If you are local the landowners agent who manages the site has a office at behind dunkin doughnuts although it doesn't look like one as no windows.
