Carers element denied uc

My son has been having to help me with my disabled daughter for several months  now.
He just claimed the carers element immediately kicked out as I am claiming carers it's an underlying entitlement as I am now over pension age.
Is this right as you don't have to claim carers to get the UC care element.
I don't get anything from it at all bit not sure if it affects my council tax 
He only claimed med yesterday already. Kicked out and now treating him as new claim.

    Underlying entitlement to Carer's Allowance will qualify you for an additional amount in means tested benefit (called the Carers Premium or Additional Amount for Carers). Do you get Pension Credit? if so, you may be getting this additional carers amount in Pension Credit. If you don't get Pension Credit you may still find that the underlying entitlement means you can get more Housing Benefit or Council Tax Support.
    Only one person can get an extra amount in a means tested benefit for caring for a disabled person who gets DLA, PIP or AA. For your son to get an extra amount in his UC you would have to give up your underlying clam to Carers Allowance. As above, if you do this you would have to check that you wouldn't lose out financially.

     I am a disregard for council tax as carer. I'll have to check with the council for that.I don't  know if you need it for that .
    Seems so crazy you don't have to claim carers. To get the UC element.

    Indeed but the same rules apply and 2 people can’t claim for caring for the same person.

    I need to check something as claiming a discount for council tax as a carer is different to claiming carers element in UC / Carer's Allowance benefit:
    Have you ever claimed Carer's Allowance, whether or not it was ever paid, and if you were paid it at some point has it has since stopped (eg when you got to pension age)? I'm assuming you have claimed CA at some point if your son was prevented from claiming the carers element in UC. The reason for asking, and if this might apply I'd advise you to double check before doing the following, is if you do have underlying entitlement to Carer's Allowance, but get no financial benefit from it, then you could contact Carer's Allowance and have your underlying entitlement removed which would enable your son to claim CA and / or the carers element in UC.

    In order to get Carer Element you have to give the name of the person you care for and they have to get PIP, DLA(DL component)etc and to provide 35 hour of care and not have someone else claiming CA or CE, if the person named doesn't get one of those disability benefits then you can't get CE. UC always contact them (or parents if children) to ensure it's legitimate. Not crazy at all especially since their is no financial gain from claiming CA and UC together unless you like weekly payments.

    Your son won't be eligible for CE or CA if you have entitlement. You will likely be entitled to the Carer Premium or equivalent unless you remove it and allow your son to claim instead.
