Disappointing update for this. Due to a last minute unforeseen circumstance I was unable to take the mediation call and had to pass it on to a friend to represent me.

After explaining to them to offer £5 max, they must've been spooked by whatever was said, panicked and accepted to settle for £500 (down from £1000) over 5 instalments.

Is there any way to change / redact this and explain the miscommunication?

The small claims mediator has a phone number and the settlement email says 'If there are any mistakes in the terms please let me know the details within 5 days.'

Any help much appreciated.

OMG no. Some friend…! They've just cost you five hundred quid.

You cannot renege on what that person accepted. Jeez! I would be so angry!

You could & should have NOT TAKEN THE CALL. You could have asked us first; we'd have told you that mediation is unimportant: as it is a small claim, you didn't have to answer the call and it wouldn't have affected the case.

Joke. Is there no way to ring the mediator and say there's been a misunderstanding and i'm not paying that?

Not that I know of but it's hard to be sure because litigation has risks and I'm not a solicitor.

I suspect reneging might be unreasonable conduct. See what @Johnersh thinks. He is a solicitor.

The main question to ask is on what basis the friend conducted the litigation…

Is there a document or some other authority/scope?

In the absence of that authority or a named legal representative how can the friend have proceeded in the absence of the defendant. They cannot be a lay rep, they are not a solicitor and, as a court sanctioned mediation, the discussion is arguably an ancillary function to the litigation (Mazur)

Did they have ostensible authority?

Did the mediator or claimant labour under the misapprehension that the friend was in fact the claimant?

What was the authority that the friend was given?
