PCN residential visitor parking

hello :) the company that issued the windshield PCN is registered with IPC so as i understand it i need to wait until i receive the NTK. the PCN also lists "n/a to n/a" as the observation time - i am unsure if this invalidates the PCN. i will be making a complaint to the building manager as well as the property agent (who also trade as the building manager) - as will my friend (the tenant as that should hold more weight) i was visiting.
the PCN claims the car was parked in someone else's spot however all allocated spots have numbers or letters to identify them while the bay i was in was one of two unmarked bays. the 2 bays themselves are not explicitly marked as "visitor" (or "v" as i have seen be used in other places) and the building/property management do not have a process for applying for visitor/maintenance permits in any reasonable way whatsoever. with this information in hand, it seems a reasonable assumption that these unmarked bays can be used for visitors. the basis of the complaint is that i believe management do not make reasonable accommodations to allow their residents to their right to peaceful enjoyment which includes having visitors.
i wish to know if these are legitimate reasons to complain (and perhaps help with the wording!).
personally it seems as though someone is opportunistic especially given the time of year as the vehicle as well as others have been parked in these two unmarked spaces at various times of year and never accrued a PCN.
i greatly appreciate any help

    Anyway if you can get good photo evidence that this is an unmarked, un-numbered bay, and a pic of the t&cs sign for us to look at, then I would give the bent appeals process a whirl.

    In 20% of cases the PPC drops out. Even if not, yet another non-impartial joke if an IAS decision will be welcomed on my IAS Decisions thread, and you can/should ignore the scammers anyway after an IAS 'loss'.

    But try a complaint to the managing agents first. Do not look for template complaint words; that's pointless. But we are happy to review something you write.

  • hopefully the photos are attached correctly of the sign and the parking bays. the numbers run up to 40 (closest to the camera) and count down away from the camera. i have additional photo and videos of the surrounding bays that make it clearer that these two bays do not have the same kind of markings to identify the bay.

    as for the complaints i plan to say

    Dear [Property/Building Manager]

    I am writing to you to complain about your lack of visitor parking processes for [building] and the subsequent PCN issued by [PPC] presumably acting on your behalf. 

    While a sign posted indicates people should park in allocated bays there is no clear process or location for guests or maintenance personnel. Given that the parking bays have numbers or letters to identify the bay, it is reasonable to assume that the unmarked bays on the property could be used for visitors.

    There is no building manager on site to make a reasonable request for guests to park and security on site has no authority for anything in regards to this incident either. [in tenant version - This issue has made it increasingly difficult to peaceful enjoyment of the property which includes my right to guests]

    not sure if its worth making reference as well to my friend's lease only stating that the tenant has to acquire a residential permit but nothing about visitors.
    also wonder if it is worth requesting that property/building management look to rectify the situation by including designated visitor bays or visitor permits "to prevent future incidents" or not 
    formal writing isn't my strong suit so again greatly appreciate any advice to really nail the point

    Yes, they cannot cancel it if they don't have the number to refer to!

    The problem here is that the IAS will simply see
    it as allocated bay parking only, so if you don't have an allocated bay you aren't permitted to park and agree to pay £100.

    So I wouldn't even waste your time with it (advice was before signage and photos).

    Of course, in reality, an unmarked space isn't an allocated bay for anybody and if it's "unallocated" by its very nature and nobody can park in it, the signs and lines are not clear enough. They should have put down hatched markings, not marked out an inviting parking bay. The sign appears to only be of any relevance to numbered bays anyway and have nothing to do with unnumbered bays.

    Try the building manager, but otherwise just ignore and see if you get a court claim (very few of which ever go in front of a judge).

  • hi everyone thank you all for your input, i got in contact with 3!!! different building/property managers and the responses were
    1) the property manager for 2 out of the 3 buildings does not use the PPC in question and directed me to the other building manager
    2) the building manager for 2 out of 3 buildings claims that permits are required and the PCN was issued correctly (a contradiction to the property manager they represent)
    3) building manager of the remaining building says that the spaces are private to each property and are for the owners to maintain and as they were not the developers (company house suggests they were at least involved in the companies that did development) they don't know how many visitor spaces were includes

    through further research on the basic land registry the 2 unnumbered spaces (from the photo before) are not listed on there other than potentially being under "land and buildings on the XXX side of XXX street"

    i will attempt to explain further with the 3rd agent as they seem to be the closest to actually being able to do something. i will also try to get clarity from the other 2 agents but this is starting to feel like its going nowhere. im not sure if the information i found on land registry will help in the event i have to go to court
