Mediation call tomorrow.

As far as I'm aware I should say no to any deal, then offer £5, Then £10, going up to £20 maximum.

Does that sound correct in 2026?

I only received the text reminder today. Haven't seen the email.

Should I worry that I've missed other correspondence or should everything be coming through my letter box from now onward?

The mediator called. I was asked to present my case but I didn’t think it was a good idea over the phone during a mediation session so I said I’d prefer to put my case forward in court if it came to it. I wasn’t really prepared for this part of the convo. I think I did the right thing. I didn’t think it right to get into the weeds with these types of people or try to appeal to their likely non existent empathy by presenting a case that they could then prepare for should we end up before a judge.

As well as the template on the forum sent over, I do have a compelling story for any judge involving helping my disabled mother in law.

After I explained that I didn’t think it right to present a case in the mediation the conversation (or rather the several pick ups of the phone when they called back) went like this:

They wanted £255.

I offered £5

They offered £215 final offer.

I offered £20 final offer.

They rejected and so it’s court or a last minute pull out by them, like last time I would assume.

How is my experience with the mediation compared with the majority of experiences?

Hi team,

So, unless I've missed an email, I'll be in court on Wednesday.

I'm here seeking some advice on how to play that game as I've only ever been in the jubilant position before whereby the other side pulled out before a hearing.

I have a witness for the day - my father in law. The story is a true one, we went 1 minute 47 seconds over the allowed 15 min drop off at a busy airport hotel helping my disabled mother in law and heavily pregnant wife check in with a 4 year old child in tow. We didn't park up as such, we were in the drop off bay.

One thing I've notice re-reading the Notice of Hearing is that I didn't follow a couple of orders specified on the form so I'd like to know if I've messed up badly here.

" It is ordered that: 4b: By 4pm on XX October 2026 the Defendant, in the event of a challenge, must send an up to date counter-schedule of loss to the Claimant with copies of all documents relied on in support of the counter-shedule which have not been disclosed previously.

5: If the Claimant is to be cross-examined, the defendant must file an application for an Order pusuant to Rule 32.7 by 4pm on XX September 2026. At the hearing of the application the Court will consider whether the claim should be allocated to a track and further directions given."

I'm hoping I haven't gagged myself by not following these orders. My mother had a cancer diagnosis this summer and it threw my admin organisation out the window to put it mildly.

I'm going to go back to the guide now and see if its all there for me but in the meantime any advice in addition would be very welcomed.

You should have received a court order from your local civil court, by post, not email, with the date of the hearing on it

That order will also have 2 other important deadlines

The hearing fee deadline date by which the claimant must pay the hearing fee in full, typically 4 weeks before the hearing date

The deadline for both sides to submit their WS plus Exhibits bundle to the court and to each other, typically 2 weeks before the hearing date

The 2nd post in the newbies sticky thread in announcements near the top of the forum explains this county court stage, including the WS bundle inclusions etc

Study it carefully, and its better to submit your late WS bundle ASAP, rather than not, after checking if the hearing fee was paid. It's worth noting that Gladstones currently tend to submit their WS bundle late too

Ok, so I have messed up a bit here. I have today to at least get something across.

The claimant has paid the court fee.

Visiting google earth I can see that the signs are few and poorly placed. We arrived after dark so even more difficult to see. I think I have a very strong case but am quite worried now given my error in not filing this sooner.

Is there a specific way I need to file this WS and exibits, do I simply email the court and the Claimant directly with an email - my statement along with some screenhots, with the relevant claim number or is there a specific website/ channel I have to use?
