Yes. So forget that angle.

The main wins seen at POPLA re APCOA railways PNs have been won purely on the point that the landowner authority only gives APCOA a right to issue PCNs. Not PNs.

So try that at POPLA. If you lose, so what?! These PNs time out in only 6 months, so obviously make every effort to drag your heels at every stage.

POPLA appeal done on day 32 after the date of the rejection letter gets you another month closer to the end date!

Well looky here. Popla appeal sent in on Christmas eve and email today:

"The operator has contacted us and told us that they have withdrawn your appeal.

If you have already paid your parking charge, this is the reason your appeal will have been withdrawn. Unfortunately, you cannot pay your parking charge and appeal, which means that POPLA’s involvement in your appeal has ended. You will not be able to request a refund of the amount paid in order to resubmit your appeal to us.

If you have not paid your parking charge, the operator has reviewed your appeal and chosen to cancel the parking charge. As the operator has withdrawn your appeal, POPLA’s involvement has now ended and you do not need to take any further action."

Thank you to everyone who gave advice and for pervious appealers who provided templates for me to use. I won't post mine as I believe the law has changed now and the "get outs" no longer apply.

That last bit isn't correct because APCOA don't use the POFA (not even on relevant land). We have never seen an APCOA NTK anywhere, that holds a keeper liable.

Ah okay, I thought I read somewhere that the relevant land bit was rescinded from Boxing day. My bad .
