Please could you explain how you determined the claim.Spendless said:
Under intestecy rules are you not sole beneficary?keithmac said:@Keep_pedalling , yes he was in a Union I believe so that could be a good shout, tried the work route and it was not something they offered apparently. Interesting with the Capital Gains Tax, if I were to modernise it and sell it that sounds like I`d be shooting myself in the foot?. Will have to look into that thanks for mentioning it.
@JamesRobinson48 because that was what it was for, he`s mentioned it to me in the past but more recently my uncle as well.
The way I'm reading this is your Father made a will in order to make you his sole heir, which he told you (that's how I'm interpretating 'that's what it was for' - meaning the will?) so why mention it to you which you recall happening and also more recently to your Uncle if one hadn't been made. Also why do you think your Father never made one if something had been mentionedt to you in the past?
England:
We have not been informed of a widow. -> Next level. Split in Scotland might be different if there is a widow or civil partner
We have not been informed of other siblings. -> Sole or split at this level between any siblings.
We have been informed of a brother to the deceased -> N/A

I am querying whether the OP is the sole beneficary of his father's estate if intestate (eg does he have a full sibling or half sibling with same Dad or was Dad married at the time of death) because first the comments say Uncle says a will was made, OP cant find one and doesnt think one was made. Then later when someone asks then how do you know youre sole beneficary if you can't find a will, the reply comes that 'because that is what it was made for and has been mentioned in the past'1 -
I am sole beneficiary under intestacy rules in England.
The question was more related to time if anything, will going through intestacy go from a few months to a half a year or more?.
As for the property, I`m mindful of my dad`s next door neighbours and having it empty for months on end but if that`s what has to happen then there`s not a lot I can do about that until probate has been granted.
I suppose one good thing that has come out of all this is I`ll be making a list in case me and my wife pass away so my two children don`t have to go through the same.

Being more attentive I agree.0 -
Might be worth seeing if the will has been recorded at The National Will Register.0

Or with HMCTS who charge a single fee. Although I think that should generate an access code required by the executor?narrowboatboy said:Might be worth seeing if the will has been recorded at The National Will Register. If you've have not made a mistake, you've made nothing0
