Private Parking Solutions PCN - No Ticket on Car, Blurry Photos, Blue Badge displayed POPLA Appeal?

Hi everyone,

I’m looking for some advice on a Private Parking Solutions (London) Ltd (PPS) Parking Charge Notice I’ve received. location - Royal Victoria Dock, 1 Western Gateway, Royal Docks, London, E16 1XL.

Summary:

  1. No yellow ticket (Notice to Driver) was placed on my car at the time.
  2. There was (no ANPR) camera system – just a warden who took some photos.
  3. The photos are evidenced (see attached) are blurry and unclear, and the time on the PCN when checked online states (08:00) doesn’t match the photo timestamps (20:34).
  4. A valid Blue Badge was displayed in the car at the time. 


PPS later sent a postal PCN claiming the car was in a “Busy Bees permit space without a valid permit.”

I appealed to PPS on 29th October 2025 as the (registered keeper) explaining that:

a) The PCN doesn’t comply with Schedule 4 of the Protection of Freedoms Act 2012 (no Notice to Driver + no ANPR = no keeper liability).

b) The evidence is unreliable and contradictory.

c) The signage provided as evidence is unreadable, so no valid contract was formed.

d) They failed to make reasonable adjustments under the Equality Act 2010 for a Blue Badge holder.

On 04/11/2025:

PPS rejected my appeal, claiming:

a) The signage is “clear and prominent.”

b) They can issue a postal PCN even without a ticket.

c) The Blue Badge doesn’t exempt the driver on private land.

d) Reasonable adjustments only apply if I had contacted them in advance 


thats all they have addressed! completely ignoring the points i have made for appeal  


I’ve now received a POPLA code, and I’m deciding whether to appeal to POPLA or pay the £60 discounted charge. 


Has anyone had success appealing similar PPS cases at POPLA on PoFA non-compliance or disability rights** grounds?


Any template examples or experience would be much appreciated before I submit my POPLA appeal.

    LOL, utter scammers.

    I particularly 'love' (not) their lies about the Equality Act duty to make 'reasonable adjustments'. Their lies completely ignore the anticipatory duty on them as a service provider, to avoid indirect discrimination of the disabled population at large.

    Individual disabled people do NOT have to contact service providers in advance and tell them about their needs! OMG they need locking up.

    This is a good point for POPLA:

    Is the NTK definitely non-POFA, too?

    PoFA Schedule 4 Requires

    For a private parking company to transfer liability from the driver to the registered keeper, their Notice to Keeper (NtK) must meet strict rules under Schedule 4, paragraphs 6–9 of the Act.


    I have stated in my appeal the following:

    • No Notice to Driver.

    • No ANPR capture.

    • PCN sent by post citing a “warden-controlled site.”

    That alone means it cannot rely on PoFA because the Act only allows keeper liability when:

    • There’s a valid NtD followed by a NtK after day 28; or

    • There’s an ANPR capture and a compliant NtK within 14 days.

    So, the keeper cannot be liable — only the driver which i didnt identify

    Not sure I agree. They are allowed to issue a PCN by post.

    What? Why on earth do you think £100 is at stake?! Literally NOBODY pays!

    Wow. Sounds like you need to read the official MSE Guide linked at the top of the page (checked this Summer by me and by Martin Lewis himself).  Nothing is at stake.

    Asked to pay doesn’t mean that you have to pay. In fact you will probably not have to pay anything

    If that is the case, shall i go ahead and risk it and appeal to POPLA? based on the points i have mentioned and the response received by PPS?
