Remortgage Issue
Comments
-
It reads as if we are referring to a form LL restriction, most commonly applied for when owners might be feeling vulnerable/susceptible to property fraud. For example those not living at a property.
Some conveyancers apply for the restriction as part of the 'service' they offer, which is fine, but it then restricts the owner and requires them to comply with the restriction in the future. That can be an issue especially with a remortgage where the conveyancer acting often works for the lender and not the borrower.
Applying to remove the restriction is relatively routine using a form RX3 plus a conveyancer's certificate which complies with the restriction wording. That means they need to confirm your identity as a result.“Official Company Representative
I am the official company representative of Land Registry. MSE has given permission for me to post in response to queries about the company, so that I can help solve issues. You can see my name on the companies with permission to post list. I am not allowed to tout for business at all. If you believe I am please report it to forumteam@moneysavingexpert.com This does NOT imply any form of approval of my company or its products by MSE"0 -

thank you for replying for such a routine procedure to get it removed, whys it taking over a month I’m now not going to hear back until possibly the 8th December I’m told, which is a month after I told them to get it removed I’m meant to remortgage by the 1st Jan. Which clearly isn’t going to happen and im going to be out of pocket

Did you ask the original conveyancer why they had applied the restriction without your knowledge or request and how it impacts your ownership going forwards?
I understand you may have some issues but it might also be a heads up to many that these services, Land Registry, DWP, HMRC etc are part of the civil service that many feel is bloated and needs to be be trimmed back.
As such the response times will only be extended. It might be something we need to get used to.

As the land registry account above says it’s a pretty common restriction they put on, just would of been nice to of been told it was getting removed from June instead of me rushing to get it sorted now.BikingBud said:Did you ask the original conveyancer why they had applied the restriction without your knowledge or request and how it impacts your ownership going forwards?

Luckily it’s now all gone through and cracking on With the remortgage.0 -
So you got beyond the problem but still don't know why it occurred.
LR say it happens but you have no idea why. Not sure I would be satisfied but it is up to you.0
