Hello Good People,

DCB LEGAL LTD have submitted a claim on behalf of Smart Parking ltd. I have responded to Letter before claim and now I have received Claim Form from Civil National Business Centre. I followed your Posts on submitting AOS and I am now considering my defense. Here are few points about the case

1- This is an old case from May 2021
2- At the time I submitted an appeal to Smart Parking but did not receive any response, I have a screenshot of appeal screen  showing the PCN number. DCB in their response to letter before Claim said I did not appeal
3- The parking is in Shopping centre in which I stayed 30 minutes, can a point be made about the fact shopping centres in the area have usually time allowed but this one does not have ?
4- It was evening between 20:00 - 20:30 even there was lighting visibility was not good to read signs/contract

Please share your comments and if any of the points I mentioned above could be point in the defense , appreciate all the help you give to desperate motorists

I uploaded a screenshot of the Claim form

Just alter a recent 11 paragraph defence as seen in numerous other threads here by the sane claimants,  adapting paragraphs 2 & 3 to suit your own case

Leave all the stories and background information for your WS plus Exhibits bundle next year

Did you out the driver in the appeal?

Please just copy another Smart Parking defence. We don't even need threads about them! Just copy another Smart Parking defence because there's an extra paragraph.

35 links to Smart cases are in a post by me on page 14 of the Public Consultation thread so they aren't hard to find on the forum.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

I don't remember if I did mention the driver in the appeal, it was long time ago

Claim was issued, 05/11/2025 and I did AoS 10/11/2025.

Thanks, so on this line " Leave all the stories and background information for your WS plus Exhibits bundle next year ..." Do you mean I leave stories and background for when i have a hearing listed which can be next year?

Correct,  stick to the standard Smart Parking DCB Legal 11 paragraph defence on here seen in numerous recent cases

A denial and putting them to strict proof

Thanks for your help, I will use the 10 paragraph in second post and second comment (which was edited august 14). Unless I am in the wrong place it is 10 paragraph not 11
