Hi all, I’m after some advice please. I hit a pothole November last year. The pothole had been reported and repaired over 15 times in 18 months, multiple times reported by me. I submitted the fast claim and it was rejected. I submitted a FOI, that dragged on and was eventually rejected as I “could use the information in court”. I then submitted the claim again, copying the local MP and CEO of council. It went to the insurers. I know that the council took 2 months to send some information to the insurers. The 90 days quoted has now passed and they’ve said I’m welcome to seek legal advice or go to CAB. Does anyone have experience of the process just taking forever and is it worth me seeking legal advice? Thanks in advance!

how much is the claim worth?
how much time have you invested and how much do you value your time
only you can make that decision0 -
If you knew the pothole was there, and have reported it multiple times, why didn't you simply go around it or slow right down for it?
What classification of road are we talking about?0 -

If it breaks, well it wasn't working right anyway.1 -
The OP confirms it has been repaired almost on a monthly basis, so well aware that it could be a danger. Hence it would have made sense to be extra vigilant rather than assume it’s been repaired, to a less than professional standard.Ectophile said:Mildly_Miffed said:If you knew the pothole was there, and have reported it multiple times, why didn't you simply go around it or slow right down for it?Because it was supposed to have been filled in.Do you weave around potholes in the road that aren't there any more when you're driving?Mortgage free
