This is regarding the 2nd PCN that I recieved and is exactly same as my previous thread. https://forums.moneysavingexpert.com/discussion/6615384/help-needed-dcb-legal-letter-of-claim-for-i-park-services-pcns/p1?new=1 - The mediation call was not successful in the 1st case.

in this 2nd case, I have received the following court claim on 13th Oct 2025
https://drive.google.com/file/d/1N0noHviL4Q4gYJJizQ816xdclrKxJul6/view?usp=sharing

and I completed AOS on money claim the same day.

Can I now proceed with filing the same defence as below:

In this case, the driver stopped for less than 5 mins!

With an issue date of 08/10/25 and having completed the AoS in a timely manner your defence deadline date is 4.00 p.m. on 10/11/25
Is that defence is based on the Template Defence?  The Statement of Truth is out of date.

Thank you very much @Le_Kirk for pointing that out.

I have updated the statement of truth and also Para 2 and Para 3, as I was not the driver that day. I hope this one is good to go?

If you are submitting via MCOL and using the defence template, you don't need the header and footer because I believe that is/should be picked up from the claim form.

Just do what the Template Defence thread says. Not by email for the defence.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

In 1st week of Dec,25, I received the following email from DCBLegal.

    ««««START »»»»»

    Good Morning

Having reviewed the content of your defence, we write to inform you that our client intends to proceed with the claim.

In due course, the Court will direct both parties to each file a directions questionnaire. In preparation for that, please find attached a copy of the Claimant's, which we confirm has been filed with the Court.

Without Prejudice to the above, in order to assist the Court in achieving its overriding objective, our client may be prepared to settle this case - in the event you wish to discuss settlement, please call us on 0203 434 0433 within 7 days and make immediate reference to this correspondence.

If you have provided an email address within your Defence, we intend to use it for service of documents (usually in PDF format) hereon in pursuant to PD 6A (4.1)(2)(c). Please advise whether there are any limitations to this (for example, the format in which documents are to be sent and the maximum size of attachments that may be received). Unless you advise otherwise, we will assume not.

    Kind Regards,

    Litigation Support

I have been waiting to hear from the court to direct me to file N180. I have not heard anything since but received the following 'General Form of Judgment or Order' through post this morning!

    GeneralFormofJudgementorOrder.jpeg

Should I just submit the N180 via email as usual or should I do anything different as this appears to be a warning notice?

    Thank you in advance.

    It's your last chance saloon.

You must email it! Download a copy, do not use the paper version and do NOT scan it. Must be a PDF attached to your email.

But the main concern is, the CNBC sent a N180 by post to an address somewhere, so check two things on MCOL:

    1. The defended Claim 'history'. When does it say the DQ was posted to you?
    2. check your data profile on MCOL or the Govt Gateway account you used. Your old address isn't on the Gateway account is it?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you for your prompt response. I have now downloaded, completed and submitted the N180 form via email.

    1. It says it was posted on 15th Dec
    2. My address on MCOL is correct.

Good, as long as the email didn't attach scans or photos, and it was sent to the DQ email address shown in the Template Defence thread AND you got an auto-receipt (which we don't need to see).
