Parents left a will, named executors and beneficiaries.

Hi. My parents both left mirror wills. My Dad dies 13 years ago. When my Mum dies, we have her Will to execute. Executors and beneficiaries are all named. We will need to sell her house to settle the estate (in Scotland and less than £250k). My question is, will we need to apply for Grant of Confirmation, to execute the Will or is the Will enough?

  • For clarification, we have had other bereavements and fairly straightforward estates to settle, without property. 
    For my Mum, everything is detailed in the Will. Do we just deal with the Will, or apply for Grant of Confirmation, wait for it to be granted, then deal with the Will?

    The executor will need to apply for Confirmation to sell the house.

    But was the house jointly owned? If so, was there a survivorship clause in the title? And was Confirmation issued in respect of Dad’s estate?
