EuroCar Park pcn. 2hr time limit even when outside of hours charges apply

Hi forum. Confusing car park - M&S in Cowes on IOW.  street view version of sign attached (I’m getting a real up to date one before Appeal it hasn’t changed apart from the amount)

Parking signage details that there is 1hr free. Second hour 2 GBP

Sign details the parking is limited to 2hrs. 

Sign then says charges only apply 08:00- 18:00 Monday to Sunday inc bank holidays. 

Sign also details the charge for failing to comply with terms.  (85GBP)

I parked one evening for 2.5hrs from 19:52 to 22:26. 

I looked at the sign when I arrived and reasonably presumed no charges applied. 

I intend to appeal on grounds that the signs are not clear and unambiguous per the BPA code of conduct. 

And further that since they state charges only apply 0800 to 1800 that they therefore cannot demand another parking charge of 85GBP as this is indeed making a charge outside of their stated hours of applicability. 

Love to hear any thoughts / views on this.

I agree it is confusing.
But to me these car parks are only free to customers as it states at the beginning

Just go through the motions of appeal, rejection, POPLA appeal, rejection, ignore all useless debt recovery letters, county court claim, defend using the template and wait for the inevitable discontinuance.

End of. We don't need to now about everything in-between. It will be discontinued if you simply follow the advice in the Newbies thread.
