Administrator having sibling trouble

I would be tempted to reply that YOU Have letters of administration and under English law are the only person who can deal with this.
PS agree not unusual for a pension to stop with the spouse / child0 -
Hi AP3 I'm not dealing with her and have nothing to do with her, i think shes got alot of cheek ( biting my lip here being polite) she's poking her nose in where it really doesn't belong1
-
Do you have all the assets from the estate yet ready to distribute?1
-
I've nothing to do with her, haven't spoken to her for about 40 years, I think they were after his pension, but it would have only gone to spouse or dependent children, they're just trying to grab as much as they can and getting involved in stuff which is none of their business1
-
Hi KP, not quite, if they're talking about lawyers I'll have to budget for protecting my brothers estate,it just makes it harder,,0
-
If you (as Executor) need to involve solicitors, the costs will come from THE ESTATE, not you.
Is your sister a named beneficiary? If so, she gets what the will says she gets.
Or is she (perhaps along with you) a residual beneficiary? ie everything not left to a specific person and left over at the end goes to X and Y?
Signature removed for peace of mind0 -
Is the problem here the timescales perhaps? Is the sibling assuming you are struggling with the admin, based on the assumptions that things should be sorted by now?No need to put estate monies aside for solicitors to protect the estate (whatever that means). If you are near to having all the funds collected in, surely you will be able to finalise the estate accounts and distribute according to the intestacy rules very soon?0

What are they surmising here?Bazza_a said:UPDATEHI THIS IS A MESSAGE I RECEIVED FROM MY SISTER'S DAUGHTER, (she isn't even a beneficiary)
they were trying to see if they could get his pension but it only goes to his spouse or children of which he had neither, SISTERS DAUGHTER LIVES IN AMERICAReceived 9.05pm on Saturday 20th December.
Hey Barry, this is Tiffany.

He wouldn't just leave it to some female.
That's not who Kevin was.

What pension is it and what did the expression of wishes form say, if completed? I am assuming DB, with payments to widow or dependent children.
You have not mentioned any other party. Is there a partner, civil or long term cohabitee, of any sort that might have a perceived claim or has caused a historic rift?
Being benevolent toward them, I know, they may not grasp the niceties of DB pensions and not understand there is no pot that falls into the deceased's estate like a DC pot would.
I'm very much with others that suggested that there is nothing, zilch, zip, nada, sod all, not a sausage, jack, scratch, diddly squat, in terms such that the American lawyer might readily understand.1 -
if she wants to get legal, refer her to Arkell vs. Pressdram?
(you might want to Google it first)All shall be well, and all shall be well, and all manner of things shall be well.
Pedant alert - it's could have, not could of.2 -
only sensible answer - nearly got used in our family over a probate issue last week but in the end we thought better of it.elsien said:if she wants to get legal, refer her to Arkell vs. Pressdram?
