    Thats Correct

    The judges in Manchester are excellent at weeding out the errors in these private parking court cases

    They have put the onus onto the claimants lawyers to file a proper POC and clarify if they are invoking Pofa2012 to transfer liability to the keeper, or not

    But Smart Parking didn't invoke Pofa2012 compliance in 2021, so unless they actually know who was driving, they lose. I expect them to discontinue in due course

    If it does happen, they should allow you to amend your defence based on the new POC, should you need to

    Its an excellent return volley by Judge Fisher at Mcr court ( its usually Judge Iyer, who mentors them there. )

    …….. and when you do get confirmation, can you scan/photograph and post the whole page of the order please. Meantime I have saved the order as is for use later. It looks like we can see a name of the defendant on that order.
